Microsoft Stole My Xbox 360 Hard drive...

So I had to get my Xbox 360 repaired as it died within minutes of opening it. I got it warrantied and the representative told me to send it in with the hard drive. I asked again if I should include the hard drive and he said yes. He did tell me to not include the face plate though...
Anyways I received my Xbox 360 back on Oct 26, 2006 without the hard drive. I called the repair center and the representative told me the hard drive will most likely arrive in a separate package in 1-3 days... I called back on the 2nd day and the representative told me something about a tracking number so I thought maybe it has shipped. About 2-3 days later I still did not receive it so I called back again and spoke to a supervisor who created a work order for the hard drive. I did not get the hard drive in 3-4 days so I called back to speak to another supervisor and he said the work order froze. He would have to cancel it and place another work order. Soon after I received an email about how a face plate has shipped so I immediately called back to speak to a supervisor who said he would create another work order and that was about 2-3 days ago from today... Still no email about my hard drive being shipped.

When I inquired about overnight shipping the supervisors specifially told me they cannot get overnight shipping. They cannot manually get an overnight shipping label. They cannot give me $100 for the hard drive. They cannot give me any money at all. And the only compensation I can get is PGR3, Kameo, and PDZ...

Also I filed a Microsoft Corporate Complaint and they were suppoed to contact me in 4-6 days, but it has been passed that so I called Microsoft back and they emailed the Corporate complaint center again. Still not call and it has been about 2-3 days since she told me she sent the email to Microsoft.

Now what would you guys do in this situation? I can't complain to the repair center as they are the ones who are causing this problem in the first place. Microsoft Corporate will not call me about this issue at all... I'm thinking about getting some legal action going on here and if you guys can help me that will be great.

I should've filled a BBB report a week ago, but I was pretty confident Microsoft Corporate would call me back. Seems like Microsoft as a whole offers pretty bad customer support.

What are the chances of me getting a fair compensation for the loss of my time and nothing having a fully functional Xbox 360 Premium?
I was thinking over a $100 now and not a <$20 video game... From what I see it to be it has almost been a full month without the hard drive (About 23 days).

Zero chance for loss of time. You will get the value of the item, nothing more.

So, if you sent something in for a repair and the company decided to just keep it, you would just buy another one?

From the wording of your OP I thought they were offering 3 games, which sounds like a pretty sweet deal.

These games are "Greatest Hits" now and priced at $19.99 each. A new HDD is still $100.00

Well.. it totally sucks, but what did you expect from micro$haft? Definitely follow through with BBB, if for nothing else to leave a mark on their record, and I liked the suggestion to contact the attorney general as well.

Another reason why Microsoft has become completely worthless

That's what happens to companies that get complete (or even almost complete) monopolies, even good ones.
Their costomer service goes right down the tube.

But their games console department is nowhere near a monopoly...

Sorry for the confusion. They told me I had a choice between those 3 games and couldn't get all 3.

Yes I should have, but here is what happened: when I heard the representative say do not include any accessories with the Xbox 360 I immediately asked if I should include the hard disk or not. He replied I should include the hard drive along with the Xbox 360. I might've asked him again later to confirm what to ship, but at the end I got the message to send the hard drive with the Xbox 360. My guess is the call center probably records all their calls, but chances of me getting a transcript from them is none.

That's weird. I know for a fact they tell you to never include the harddrive. There have even been many instances where MS sends a free extra harddrive in return.

Well the representatives I spoke to after I did not get my hard drive back said when this happens the repair center usually send the hard drive back in a separate package.
Also they said the hard drive was not supposed to be sent in with the hard drive. I was really tempted to say "no ******", but decided to just say the first representative told me to include the hard drive with the Xbox 360.

fari compensation for loss of time? bwhahahahahhaha yeah sure.

what you should get is a refurbed HDD sent to you. thats it. maybe a cheap free game if they are feeling nice.

yeah usually they say NOT to send anything. it even should have come with paperwork that says not to send it.

You could. When I sent in my Seagate 300GB HDD, I had to wait 3 weeks. They shipped me a 400GB drive instead.

Usually common sense says not to send anything when they say do not send any accessories. So to make sure I did not have to send in the hard drive I myself asked the person should I or should I not include the hard drive. His answer was yes so I included it. The reason I thought is perhaps the problem could be linked to the hard drive (I told him is most likely wasn't since it still froze without the hard drive attached) so I still shipped it with the hard drive.
I don't know if you were being sarcastic or not, but in this situation I think almost everybody would be completely angry and demand some sort of compensation.

and what are you out? well besides the HDD. yes they should give you a refurbed unit.
but other then that? NO.

you are not "harmed" in any way. big deal you can't play for a while that is not something you are going to get compensated for. to even say you deserve it is stupid.

now bitching at them may get you a new game. but do you deserve it? no. and there is no way to force them to (at least not that i know of).

Bullshit! He's spent time calling these guys every few days. How much is your time worth?

That, alone, is at least worth something, however insignificant it may be.
