Usually common sense says not to send anything when they say do not send any accessories. So to make sure I did not have to send in the hard drive I myself asked the person should I or should I not include the hard drive. His answer was yes so I included it. The reason I thought is perhaps the problem could be linked to the hard drive (I told him is most likely wasn't since it still froze without the hard drive attached) so I still shipped it with the hard drive.
I don't know if you were being sarcastic or not, but in this situation I think almost everybody would be completely angry and demand some sort of compensation.


and what are you out? well besides the HDD. yes they should give you a refurbed unit.
but other then that? NO.

you are not "harmed" in any way. big deal you can't play for a while that is not something you are going to get compensated for. to even say you deserve it is stupid.

now bitching at them may get you a new game. but do you deserve it? no. and there is no way to force them to (at least not that i know of).

first off you mean premium, and secondly I agree that you get a HDD, Microsoft is worng there....But as far as something for your troubles, while it is a pain, and you did have to waste time calling I am not so sure they owe you anymore than a drive. It is a big mistake on their part, maybe you should get a microsoft bumper sticker or something. Do you have any idea how many times Microsoft screws people over?? I am not saying that makes it right, because it does not. But if they gave out freebies to every customer that picked up the phone and dialed 18004myxbox, they would go under as a company. As much as they screw up, don't be surprised if down the road you end up with 2 hard drives. I wish you well on your quest for your drive, and who knows maybe you will get a freebie afterall, but I wouldn't count on it.

no you were not harmed. you deserve a refurbed HDD. that it and nothing more.

you do not deserve to make any money off it. you do not deserve to get free games (though if you bitch enough they might throw in some crappy games. what you deserve is a refurbed drive.

yes it sucks loseing the save games. but that is not a cause to get paid for.

The BBB got me a nice call from a VP at Acer and XP Pro installation media when the Acer CSR decided to call me a smartass.

Also, I had the discs within 36 hours of filing the complaint. Filed at 7PM Tuesday, got the call from the Acer VP at 2:30 PM the next day, discs were shipped via FedEx First Overnight fifteen minutes later, I received them at 6:42 AM the next day.

I don't think I have had any information on that hard drive except the preloaded content. The Xbox 360 Premium lasted only 5 minutes and then froze. It would freeze within 5 minutes regardless of what I did to attempt to cool it. When it was powered on soon after turning it off it would freeze within a minute.

I don't feel like quoting others, but saying I deserve nothing for Microsoft's lacking customer support is just wrong. Even Microsoft acknowledges their wrong doing and will attempt to compensate their customers with 1 of the 3 games (in my OP).
One of the points to having a successful business is customer support and when it starts lacking you offer gift cards, gift checks, freebies, and other stuff like this if the issue gets out of hand. This situation has gone way beyond the norm and I again feel it isn't any more about just getting the hard drive back. There is no way I as the customer has to argue and keep calling back. It is absolutely unsatisfactory to receive nothing for the past few weeks except a face plate (insignificant value) and more stress.
I have filed BBB reports on eBay and the AG against eBay, but they haven't called me back about it. I also filed BBB reports against maybe 1 or 2 other companies, but I never did get a call back. I'm not sure if it gets sticked as a negative review against the company, but i'm sure it barely even harms the company's rep.

Alright I filed a complaint with the BBB and the WA Attorney General. Hopefully something will happen soon. I guess the next step is to research Arbitration or Small Claims Court which are both options I really want to avoid.

I dont think you want to do that. Reason being that I am pretty sure that M$ has a clause somewhere in their warranty terms & conditions that Court claims and/or arbitration can only be filed in the city where M$ is headquartered.

unless you live in the same city, it is not worth it. Just call up M$ complaint center and/or Office of the President and complain there.

Just one question, if you opened up a brand new xbox and it was Defective, why didnt you take it back to the store where you purchased it from and exchanged it ?

I did call the complain center and filed a Corporate Escalation Complaint, but they did not call me within the 4-5 days. I called the operator back who sent in another email requesting them to contact me and yet again no calls.
I tried searching up Microsoft's President with Google, but couldn't turn up any email or phone number easily. I'll call up MS again and see if they can get me the phone number of someone who can help me besides their Corporate complaint center.

you deserve a replacement hard drive. they don't owe you anything more than that. if they are nice and give you soething additional, be happy.

While I'll agree that microsoft isn't liable to compensate him for the loss of time, but he certainly deserves one to have to go through all that time and frustration. The fact is, he received substandard service. Any half-decent company would give something extra to make up for that substandard service to at least level themselves to even ground.
Additionally, he should get a brand new drive as his system was basically new when it broke. Refurbs are usually given if they break one month down the line. Getting a refurb for a DOA item is ridiculous beyond doubt.

I got it warrantied and the representative told me to send it in with the hard drive. I asked again if I should include the hard drive and he said yes

I thought I already answered that question. If you guys read you would see it was past the return period. I bought it from overstock.com which has a policy of it must be returned within 30 days.
Yes I did not use the Xbox 360 for more than 30 days. You guys can beat me on that point, but the fact is the issue is about Microsoft's subpar service not how I should've RMAed it.

I don't know why I have to keep repeating this, but IT WAS NOT MY FAULT FOR SENDING IN THE HARD DRIVE. THE REPRESENTATIVE TOLD ME TO DO SO. I did not claim they told me to send it in, THEY TOLD ME SPECIFICALLY TO SEND THE HARD DRIVE WITH THE UNIT EVEN THOUGH THEY SAID NO ACCESSORIES. Yes the system was "basically" DOA, but the hard drive was sent with the Xbox 360. A Xbox 360 requires a memory unit (such as a hard drive) to properly play games. Since I don't have the hard drive I can't play games and that is why I am saying I do not have a fully functional Xbox 360 Premium. If I can't play games, then what else am I supposed to do with it? Watch movies? I'm sorry, but I did not just pay lots of $ for a less than stellar dvd player. Besides the Xbox 360's main selling point is to play games and that is what I intend to mostly use the Xbox 360 for.
Now we all know that refurbished hard drive are CRAP and when I mean crap I have had all the refurb hard drives die/crap out prematurely. Some refurbished items are ok, but one thing you do not want to buy refurbished is a hard drive. You keep insisting over and over again that Microsoft should send me a refurbished hard drive, not my original one, and not a new one. You really are hoping for me to receive a less than normal product don't you?
Look some people have nothing better to do in their lives except to make other's lives miserable and you are quickly becoming one of them. Just because I don't share your completely passive characteristics don't go on and try to force me to adopt your ideas. By passive characteristics I mean the fact that you don't care how much time I have wasted trying to get just a hard drive back. Not to mention all the stress I have had to put in following up on the issue and being completely ignored. As of today I still have not received the hard drive so it is still hundreds of dollars spend on a DVD player.
I'm sure you like to lose money and time, but I don't.
O yea and this isn't a simple wait in line at the checkout, for a doctor's appointment, or in traffic, it is something different. If you can't make the distinction between those two then I don't know what else to say to you.
