Why do I keep hearing the talking heads on the right saying give Miers a chance and to let her talk. Why the hell are they telling us. Tell Miers to start talking and she would be listened to.

In describing one matter on the Dallas City Council, Miers referred to "the proportional representation requirement of the Equal Protection Clause" as it relates to the Voting Rights Act.
"There is no proportional representation requirement in the Equal Protection Clause," said Cass R. Sunstein, a constitutional law professor at the University of Chicago. He and several other scholars said it appeared that Miers was confusing proportional representation -- which typically deals with ethnic groups having members on elected bodies -- with the one-man, one-vote Supreme Court ruling that requires, for example, legislative districts to have equal populations.

Me olde constitutional law professor (we were still writing with quill pens then) always said that by the time a case gets to the Supreme Court, it's not about law, it's about policy! Chief Justice John Marshall was the first guy to make the Supreme Court a big deal. It's said of him that he would tell the court's scholarly judge, Joseph Story, what result he wanted and Joseph would craft it. For most of our history, Supreme Court Justices have not been judges. Consider two famous guys who may have happened in your historical horizon. The dreaded Earl Warren (Miranda warning). Never a judge. He had been a prosecutor and then the governor of California (Justice Schwarzenegger?). Hugo Black, very liberal, many voting rights cases. Formerly a member of the KKK, then a Senator. Then a Supreme Court justice. I'd rather see someone with common sense on the court.

I'm beginning to think Miers is a red herring. Bush may be trotting her out there in all her ineptitude hoping whoever he nominates next looks better.WASHINGTON Oct 20, 2005 ? Give her a chance?? You do realize this is a permanent, lifetime appointment, don't you? Once she's in, she's in for good. Supreme Court appointees should CERTAINLY be subject to the strictest scrutiny possible in the confirmation process, with no exceptions.

Judge Judy made the best comment IMHO, 'In Europe they have actual schools for Judges, with examinations'. I believe that I qualify for a Brain Surgeon, I have about the same experience as Miers has as a Judge. To think that she is nominated to replace Sandra Day O'Connor makes me sick, I thought that she deserved the job as Chief.

Absolutely not! It has everything to do with tha fact she considers Pres Bush a very intelligent person. Which leaves me completely confused and frustrated - I don't know whether I should laugh or cry.
