Since Voip decided to take this public.
Here is the eBay auction description:
"Here you have a great camera for sale, does not come with cables, sd memory card, or batteries. Great camera with minimal usage."

I get the camera, sent to me after a week of no responses to my inquiries of what was going on - did I mention I paid the same day the auction finished? (but that isn't part of this problem). It arrives via UPS. The camera is wrapped in bubble wrap. The bubble wrap is in a box of packing peanuts and with no physical damage.
After installing new batteries and a 256MB SD memory card the camera would not even turn on. The lens tries to extend but is unable to. Maybe it is the batteries? I tried them in a different electronic device and they work just fine. Maybe the memory card? Try it in a friends E323 and it works just fine.
:EDIT: I forgot to add (still early) that the battery cover had one broken clasp on it so that the cover does not stay closed very well. I would think that is way beyond minimal usage. :/EDIT:
So, it is not the batteries or the memory card. It must be the camera. So I send the seller an email letting him know that the camera does not work and that I want my money back. Here is his response:
"I tested it when I found it, it worked fine for me. Yes I do mean *found*. I found the camera at a local aracde. Do you have an SD memory card inserted? That might be the problem. Even if it actually doesn't work, it's not my problem; I never stated in the auction whether or not it actually worked or not. If theres something wrong with it, it's either UPS's fault, or your fault."
My favorite part is "I never stated in the auction whether or not it actually worked or not".
So I did file a case with TradeSquare and paypal because this eBay seller sold me a camera that doesn't work and I desire to get my money back. I have even offered to pay to return the camera to him.
