Magidson's attorney argued the case was not murder but manslaughter, a crime of passion triggered by sexual fraud.

I don't think it should have been tried as a hate crime. They didn't seek out a victim based on sexual deviances like has been encountered in other cases (Matthew Shepard).

Your quote and opinion contradict. If it's a crime of passion triggered by 'sexual fraud' then there's even MORE reason to try it as a hate crime. It's like the KKK hanging a black guy and then saying that it's not a hate crime because of the "the color of his skin."

I'm thinking 2nd degree. I don't know the state laws though. First degree usually involves premeditation of the crime itself. If they didn't show up knowing they would kill him/her, it wouldn't qualify.

Vadatajs, what I'm getting at is that they didn't go out looking for a victim based on the characteristics. The victim thrust him/herself on them.

This isn't a hate crime in any way that I think makes any sense, nor is it first-degree murder. I would call it second-degree murder, and impose a significant amount of confinement. I'm not totally surprised by the mistrial - I think there's at least a reasonable argument this was manslaughter.
