That's an interesting point - I had missed that line, probably cause I stopped when I saw forced. Which I think is much more likely the younger the... child. I think I must say child because he's not yet a teen, which is generally where I'd draw an arbitrary line on the severity of this.

A society that condemns 17 year olds is definately not living in a generation that'd tolerate this story. Regardless of what the boy wanted.

How so?

12 is more than old enough to testify in court. Therefore, one must conclude that the courts believe a 12 year old is capable of knowing right from wrong and how not to lie.

How, then, can those same courts say that 12 is too young to consent to anything? If there's no coercion involved, how can there be any wrongdoing? Assuming no coercion, it'd be rather difficult for a woman to "force" oral sex and vaginal penetration.

Repeat visits over time, perhaps, but it's not difficult to force that. Especially on a 12 year old, who is in no way going to have the size, strength, or mental capacity of an adult.

Yeah, I can't really minimize it when it's a 12 year old. Plus there's a severe age difference, so even if it's true love, when he's thirty her head is going to be the size of a VW Beetle. Regardless of what this kid said at 12 the fact of the matter is he was a kid and she was a 30 year old woman and it was rape, here is to hoping she gets some serious jail time.

In cases of statutory, we need to recognize seduction and if force was actually used. I consider it materially different if he was forced into it, if it was his idea, or if he was simply lured into it. The victim's testimony is actually quite important in that regard.

I find that distinction relevant for sentencing, or even for defining the crimes committed.
