If someone can execute an attack on a U.S. Army base killing 13 soldiers while yelling Allah Akbar and have the incident be considered nothing other than workplace violence... There is no way in hell the FBI will reclassify this beheading in Oklahoma.

What is your point? If you verbally threaten someone by saying you will cut off their head and you have the means to do it... this can be considered a criminal offense and the first amendment does not apply.
