My daughter was hurt in preschool

My wife got a call from preschool today: our daughter (3 years old) is bleeding, they are putting ice and coagulant cream on - please come over. My wife rushes over there. She finds our daughter with 2 big bloody scratches, with one starting almost from the eye across the cheek.

They do not know how it happened, because the primary teacher left for the break, and the substitute wouldn't see an elephant if it walked into the room. They told us some girl did it ('it happens sometimes, sorry'), but our daughter told us it was a new boy that came in today. She was reading a book when he came over and tried to snatch the book away from her. She wouldn't let go (it's her own book she brought in that morning), and so he scratched her face to blood.

What pisses me off is that they absolutely do not want to take responsibility for it. They are trying to do damage control ('yes, it happens, blah-blah') when the main issue is that kids were unsupervised! I am not into bullshit suits and stuff, but I want to make clear to them that if this happens again, there will be consequences.

What are my options here? I already took photos of the bruises on her face.
Thanks.

Cliffs:
- teacher left for break
- substitute is a blind bat
- kids are unsupervised
- my daughter gets bloody scratches on the face from a new kid
- I am outraged :|

Yes, if stuff like this happens again - definitely. But I don't want to just let it go - their attitude pisses me the hell off.

well you could call the cops.
call whoever is in charge of the school
find out the boys name and sue the parents

etc.

i wish i knew what to do, but i would let the school have a piece of my mind. also, i would make sure the school contacts the boy's parents and maybe see if you can talk to them

Dude little kids get injured, NOT a big deal.

Bleeding is part of being a little kid.

Dood, my friend just had the same situation happen - except her kid had his collarbone fractured. She called up some child care agents of the state who are investigating, but short of getting lawyers involved, are at a standstill at the moment. (She got the same run around as you)

They are not releasing the name of the boy (they still think it's a girl who did it!), and they are not releasing the name of the substitute either (although we know who the substitute was - it's always the same woman).

Exactly. I couldn't count how many times I got hurt as a kid.

What's next? Suing SuperCycle because your daughter fell off her bike and scraped her knee?

Bleeding is part of being a kid when you trip on a playground and fall. Or you have a friendly play, and accidentally get scratched. Getting bloody bruises because some bully came in and tried to take a book from you - not part of being in preschool.

Have her point the kid out. Go up to him and squat down like you're trying to "teach him the right thing to do" and then in a very casual tone tell him that if he ever does anything like that again you will kill both of his parents. That will scare the little bastard so bad he'll be shitting bricks for years.

My kids go to daycare/preschool, and once in awhile they come home bloodied, once in awhile they do the damage. Kids will be kids, even with supervision stuff will still happen.

Unfortunately, this happens. I have kids that young, too. Fortunately, my preschool teachers are better than yours.

But here's your problem:

Evidently you KNEW that this happens:

teacher left for break
- substitute is a blind bat
- kids are unsupervised

Yet you let your kids go there anyway.

I'm right there with you with the parental anger, but let's face it....daycare workers are about as bright as McDonald's burger flippers. This is a known hazard, unfortunately.

You might have a case if it happens again with the same boy, but at this point, I don't think there's much you can do.

He pays for her to be in a safe environment. If they cannot provide this then something needs to be done. Yea, kids get hurt all the time...but that doesn't mean it can't be avoided at times. The day care needs to have enough people on hand to keep an eye on the kids.

You can expect the teacher to keep an eye on every single kid every single second. These random things happen and as long as it's not a repeat offense, i'm not sure why it's worth pursuing.

this is why I encourage my 4YO and 2YO to play Wii Boxing. Nobody snatches a book from Baby.

This kinda shit happens in preschool. It's part of the socialization process. Talk to the principal and ask for better supervision. As a lawyer, even I wouldn't pursue this any further.

They cannot legally tell you the name of the kid. They can't tell you the parents name either because they need to protect the minor.

then your choices are

A) call the cops

B) let it go (maybe find a better preschool place)

I took pictures of it! his first real injury! lol sent it to my dad who laughed.

There was never an issue of fighting before: the majority of kids there aren't troublemakers, and they all get along nicely.
