The only ones that don't are the bottom of the barrel crap daycares that don't do jack to teach your kids anything. Any responsible parent will be able to identify those daycares at the drop of a hat and avoid them like the plague. The illegal kids being enrolled in those schools is the least of your problems if you put your kid in one of those. Trust me. I have been through this and I work for the school system in South Florida. I know all about it. Every single good daycare offers some sort of government funded Pre-K program for children who are one year away from Kindergarden. Those schools deal with the tax part I am talking about.

Oh come on. These things DO happen. The substitute is a "blind bat" because he/she couldn't watch every single kid for every single second? How long do you think it took for this altercation to happen, five seconds? If it repeatedly happens, then yea, maybe it's a big deal because this "bully" should be watched closer and/or disciplined, but come on...you're taking this WAAAAAY too far.

3YOs have no concept of social structure. In fact most of them play next to each other at best and really don't play together until closer to 5 or so.

I hate to say it, but yes, things happen. Even if it was observed, unless the teacher was within 5 feet, your daughter was going to be scratched. I agree that there should have been better supervision; but that won't always prevent things like that.

On another note, a kid tried to take a Tonka dump truck away from my son in pre-school. My son about knocked the kid out with a dump truck to the side of the head. It was observed; "it happened so fast." The other kid tried to grab it, my son said "no", the other kid tried to grab it again, my son clobbered him.

Well it seems like its a tuff situation because the only eye witness is your daughter. Unless you could get some of the other kids to speak up as to who actually hurt her, you wont really have much of a case.

If it was me, i would try to find out who did it, and either contact the school about the kid and or his parents.

You may not be able to get any sort of restitution, but at least you can make sure that she doesnt get hurt again, or that he doesnt hurt any other kids.

Maybe change pre-schools if they are going to be jerks about it, and perhaps warn anyone you know about your situation and advise them from placing their children in the same location.

Agreed. Kids grow up. They need to be taught whats right and wrong. Sue the kid's parent's for medical -- this way, the kids parents might do a better job parenting their son. Its all fun and games unless someone get a big fat bill -- get a lawyer too.

He's right. Your justification is crap. My kid has gotten hurt before like that and doesn't have any kind of fear about going to school. Nor do the children who get away with things occasionally believe that it is acceptable to do what they did. They know it was wrong and when they do get caught (happens most of the time in good schools) they get punished.

Ya, no kidding. Not to mention that not only does this sort of thing happen at least a couple times with just about every single child that spends several years in even a good daycare, but all of your little angels will also be the cause of something like this happening at least once or twice. Newsflash. They haven't grown up yet. They make mistakes which cannot be prevented by even the best parents or the best teachers. It just happens.

I hate parents that overeact to this. They're kids, bleeding sometimes is part of it. I'm still in HS, and I see it all the time.

I'm not talking about what you'd do to your kid. Don't try to read between the lines... I'm talking about suing the parents and anyone within 50ft of the altercation as many of the posters here have suggested for the OP to do.
