My God, that's awful. If worse comes to worse, you can delcare bankruptcy. Don't worry, things like this are scary, but they're work out.

i think if worse comes to worse, you should contact the media. if nothing else, you will get some donations from viewers. good luck

Hmm, crab I never knew this about you, and I'd not have guessed. You've undergone something awful and handled it far better than most people could, which indicates your powerful character. I can't imagine how much this situation sucks for you, but you're better equiped than most to handle it...hopefully things will look up for you soon. It's kind of empty to say, since I've never had anything go horribly wrong in my life, but things often do have a way of getting better - quickly, and without warning (and the opposite as well, but I think that's already covered). Goodluck!

Rather than looking for advice here, what you really need to do is to talk to the attorney who represented you in the settlement against the home owner's insurance. Your health insurer's claim is certainly not unheard of, and quite probably was anticipated by your lawyers and taken care of already. It's quite likely your new insurer is simply blowing smoke.

Do not be afraid to consult another attorney also, if your original attorney doesn't solve this problem.

Good luck. But don't think that your life is over merely because of this insurer's current position. It's a solvable problem.

Holy cow, thanks for the words! They do help!

I wont be signing anything until lawyers are contacted, including the one that initially handled the case.

I'm not committing suicide...no way. I have a great gf I plan to move in with (or vice versa). I'm not missing out on that.

What they are doing is called subrogation. Basically they want the responsible party to pay up for the medical costs. Insurance companies hate being out of pocket for anything.

Subrogation may not be legal in your state, and they may be counting on you to be ignorant of the law. I agree with those who say do not sign a damn thing until you talk to the lawyer, that is what he is paid for, to fight the legal battles for you.

If this is a new ins carrier, they may not have any rights to any money you get because of the settlement.

BTW, how did the auto accident happen? and you said something about homeowners insurance?

Honestly, this souinds like one of two things:

1) Shady insurance company just trying to get out of paying for things
2) Someone wrote "diving accident" and someone else read "driving accident" and that snowballed into a huge mess.

Lawyers are your friends. Because of the high $$ amount involved, I'm sure it won't be as easy as it SHOULD be, but I doubt it's irrecoverable.

Outside of that - I wouldn't worry too much about it. It's a total clusterf* but honestly, what are they going to do, get a million dollars out of you? Blood from a stone. Sounds like you've done a great job dealing with things so far, don't sweat the details.

I'd say your best bet is to come talk to me. I have a new mechanised attack suit that wuld be perfect for you. With your optimized rail gun, you could eliminate insurance assholes. I do not require any payment, just video of all destruction via eye camara. Rock and Roll!

Ahh...I might've left that out, my apologized. I dove into a swimming pool at a friends house.

Speaking to a lawyer now...thanks for the advice!

Don't you dare sign anything, get ahold of a lawyer &amp; go over evrything with them.

Barring that, get ahold of your state representative, they can raise hell for you too.

What the ins company is doing looks bad, and it'd look bad on the evening news &amp; they know it...

If I were you, I would do what people suggested here. Contact the local Tv stations and ask them if they want your story. I would make filing for bankruptcy the very last resort though, depending on what the lawyers advise you to do. I hope everything works out for you .
