Florida is the only state in the USA that explicitly bans a homosexual person from adopting a child. So there is quite a bit of animosity towards gay people in the law and legislature in that state. So I would be very concerned over this situation. Also, why would the laywer for the father even bother bringing up the sexual orientation of the girl's uncle, unless he or she thought it would be a winning strategy in court? Will it be expensive for the sister to hire a laywer, I wonder?

What sucks is the decision would ultimately be up to a judge, and you might just get one hell of a bad one (there are a few), but more than likely you'll come out ahead, and your sister's ex will look like a moron. No problems there, just reinforces your position for future dealings with him.

After you win, your sister should take him to court to get a higher child-support payment.

It is quite possible that the guy doesn't care, but is using it as a convenient situation to get custody. Women do it all the time. They want custody of the children, so they claim sexual abuse of the children against the father. It's pretty common and disgusting when done by either gender.

Unfortunately, venue is important and the initial verdict basically rides on the personality of the local judge -- there are a lot of troglodytes out there. Be fully prepared to appeal if the decision somehow goes against you.
