My NYC employer wants to dock my pay for lateness / going over sick days

yeah, but you are using it as leverage, which is your justification to being late. You spend the first 3 paragraphs saying how great you are at your job and how the place would become messed if they let you go. Stop being an A-hole and just suck it up.

Just so you know....your company can deny your unemployment if they can prove that you purposely violated company policy....that is how it works in MA.

My advice. Get your ass out of bed in the morning. 9 is not at all unreasonable.

Now heres why I say this. If they do follow through and really for real fire you you are going to have one hell of a time finding another job where you could pull this shit. Which means if you think it sucks now you aint seen nothing yet sunshine.

I do have a problem being docked illegally, and I'm asking if anyone knows for sure. Can you help?

I deal with this stuff all the time. Basically if you live by the letter of the law, you can't get in trouble. Simply get to work when you are supposed to. Easy fix.

If I quit, I don't get unemployment. I support my 77-yr old father, and have been supporting my family since I was a kid. I don't have the luxury of going without pay for any extended period.

LOL! So, you don't care if they fire you but yet, you're worried about not receiving money for an extended period of time. Are you serious? You think receiving unemployment will make up for your salary?

Here's an idea to ensure you keep receiving your pay. Get your ass out of bed and get to work on time. You sit there and laugh about being late because you think you're "good" at your job. I've seen lots of people come and go who thought they were indispensable, and when they were gone, everyone found out they weren't. Oh, and good luck not only finding another job in this economy, but getting 15% raises just because you ask. You are working for a pushover and the joke is about to be on you.

but instead you are calling in and when you do decide to get your lazy permanent 99%'er ass out of bed you show up late.

I'm TERRIBLE for coming in late. Always a few minutes late, but still a very bad habbit. It's worse now that it's winter and I have to spend 10 minutes scraping ice off the car before I can leave. This morning I was like 10 minutes late.

I should be fired. I've been working on trying to force myself to get up earlier. I totally lack motivation at my job though, because I'm not even suppose to be working there anymore. They're just taking their sweet ass time moving me to my new job.

so you are getting paid for these sick days and late time? are you salaried or hourly? Don't recall seeing that in the OP. If salaried, move to hourly. when you are sick beyond your allotted sick days, take vacation time or no pay.

This is pretty laughable. I'm really surprised that this guy's boss hasn't told him to take a hike. There's plenty of capable people that are more than willing to take his place.

OP, they have every right to not pay you on the days you don't come in and from the way I read it if you can't come in by 10:00 they're saying not to come in at all.

i california, you will not receive unemployment if you were fired with cause, so far as i understand.

This could be considered a "performance" issue, and if they properly document that you're excessivly late/absent and it is clearly defined in the company handbook then i think you're out of luck..... granted your handbook will have steps they have to follow, for example, three writeups before you're out. it will specify what remedies you have as well as the actions they may take.... .check your contract.
