Did the police write him a ticket? If not I woudl call the local DA/police and push the issue.
If he did/does get a ticket then show up to court.
Person pulled out in front of my dad and almost killed him. Yet when it went to court the judge tossed ti as the person has insurance and he thought they would cover it. Judge did to know the injuries to my dad or anything about the case.

Someone must have been texting while driving. I've had cars in my driveway struck multiple times.

...reading OP now.

Like Ichinisan said, we had a car parked in our driveway that got hit. It was an unlicensed kid who took his uncle's van for a joyride, came tearing around a 90-degree turn at the top of a steep hill, and somehow made it half-way down the hill before hitting the ditch and ramping, airborne, into our 2000 Hyundai Elantra. Yeah it wasn't worth much, but it wasn't paid off yet at the time so full coverage was mandatory and it was fine.

Another time our mother was working out at a gym and someone hit her parked 1980 Toyota Celica mangling the front passenger wheel well so badly that it was cutting into the tire and it couldn't turn. Allstate said that, had she been in the car, they would have covered her. WTF is that !$!@#?!

I know hindsight is 20-20, but if you are parking in the street every day, it's best to get comprehensive insurance, provided you can afford it. I've heard way too many stories of cars getting hit while parked on their own street. Better Nate than Lever, right? Uh, I mean better safe than sorry.

I really wish you could punch people through the internet. Absolutely hate idiots who add emoticons to assholish, pointless posts. You don't even get passive-aggressive creativity points.

I wish you could give it a shot too. :0

Lighten up Francis.

Most states allow you to go after their assets, even with a small claims verdict. Some/most? allow you to even have their wages taken out.

My dad showed up to a business with his truck and the police showed up and the person "found" some money to pay off the claim real fast.

I won against one person but I knew he had little money. So I just had him reported, shows up on background checks and anytime he wants a loan.

But yea when I said sue I meant small claims.

I think you missed the important part of my previous post

.....sue him/her, win easily, and then get what?

If you get hit by a peniless unemployed moron that did not care and without any assets, where or how are you going to get any money? Garnish his/her wage? He/she is a bumb and has no job, drives a $100 car (if you are lucky), and lives in a $50 trailer. He/she does not care if the credit report/personal file is trashed.

Like Kyle said, win a judgment is easy, collect that judgement is the hardest part. Trust me on this, been there, done that.

I am hoping either he or the owner of the vehicle that let the insurance lapse has something that I can get.

It cost me $200 to have my car towed a mile, store overnight, and then re-towed back to my house to avoid the $40/day "storage" of my vehicle on their lot.

I really hope you do too. I know how you feel about having to pay out of your pocket for some idiots' mistakes because it happend to me before.

Here is the thread about the girl hit my vehicle and drove away and I were stuck with $500 payout ($250 deductible and $250 for rental) for almost 3K damage. Link = http://forums.anandtech.com/showthread.php?t=2104869&highlight=

At least they stopped. My in-laws were visiting a month ago and I let them park their much more expensive truck in my driveway and I parked on the street while it snowed. The next day I had a new dent in my driver side rear door. =(

22, but it wasn't his car. His girlfriends mom or his mom, I am not totally sure yet other than it wasn't his.

Get the police/DMV/insurance to find out the registered owner of the car and sue them jointly and severally along with the driver. Unless the owner can prove the vehicle was stolen they can ultimately be responsible for the actions of the driver they loaned the vehicle to.

If he doesn't have insurance, he doesn't have money. By all means sue them for nothing...

Those are called "piece of shit" houses.

About 1 block from my house is this poor bastard whose Ford Taurus has been hit a minimum of 3 times now. There was a ridge of ice forming in the middle of the street and it would throw a car 90 degrees if one of the tires hit it. Over a span of 2 days, I saw police blocking that road at least 3 times and I had to take a detour to either go shopping or return from shopping. The city eventually did get a grader on that road to break up the ice ridge, and there are little home made signs on the side of the road that say "ICY ROAD"

The lesson here is to never buy any property where you are required to park on the street. All it takes is a little ridge of ice about 1-2 inches high to throw a vehicle into your vehicle.

I don't know why, but I find this post hilarious. Getting your car hit isn't funny and a second time definitely sucks, but there's something amusing about a parked car getting hit three times in the same place.

Actually mine covers property damage, not medical bills, so yes in my case.

If you only have liability, it only covers what you are liable for to others. SIMPLE! It doesn't cover damage to YOUR property... the other party's insurance must. You have to have uninsured motorist + more than liability (comp/full).

I am filing a small claims case today, for $3,500. Whether he has it or not it will cost me $20 to file and the jackass deserves it.

The body shop said my car was a total loss.

I am sure the guy only stopped because his car became immobile.
