Need advice - Car almost totaled

My friends car was legally parked along main street last weekend when a drunk mexican hit his car, 2003 RSX, and did major damage. Turns out the mexican's insurance was very conveniently cancelled 17 mins before the accident so my friends insurance is stuck with the bill. They took it to an autobody place and they said that it's about $3000 short of being totaled which means that they are gonna try and fix his car, and something damaged that badly is never going to be quite the same.

What he wants is for the car to be totalled so he can just get his money from it and get a new one. Has anyone else had an expirence similar to this and know of a way that he can get his car totalled?

I don't think there's anything he can do except pray that when the bodyshop starts taking the car apart they find more damage and total it...

But once the insurance company starts fixing the car, there's no turning back...

Was the shop one that was recommended by the insurance company or did you take it to an independent shop? If it was one that the insurance company recommended, then they're obligated to repair it right. Also, request that they use only parts from the manufacturer and not economy parts. That way they'll consider totalling it.

Did you say what kind of car the drunk was driving? Did you say what color it was? Did you say how tall he was?

The only thing you know that is even semi important for description for this discussion is that he's DRUNK and his insurance was expired.

I think his point is that you wouldn't have mentioned his race if it was a white guy. (I don't think you're a bigot, but I think he's right that mentioning the guy is mexican is a lot less relevant than a lot of things you left out).
