The discs and packaging look exactly the same as the OEM versions I bought from GoGamer.com last year. Be sure to report them too.

Yes, I just emailed Nero to inform them of this.

Hi,

I thought you may be interested to know the in the following thread:

http://forums.anandtech.com/messageview.cfm?catid=40&threadid=1121826&FTVAR_MSGDBTABLE=&STARTPAGE=1

It was discovered a company is selling "CD Only" Nero6 products for about $10 with $6 shipping. However, if you follow the thread you will see that they eventually changed the site lable to "OEM" and still shipped OEM to those that ordered when it was advertised as "CD Only." I purchased this product thinking I was buying a legal Nero6 application, but since it is OEM, my software is not legal.

Can you investigate the issue? I am already planning on contacting my credit card company to dispute the charge.

Here is the link to the company's ad for Nero6 (now listed as "OEM") -

http://www.softwareoutlet.com/Merch...re_Code=S&Product_Code=4406&Category_Code=COM

Thank you.

I sent it to their tech support, U.S. sales, U.S. public relations, and legal/administration email addresses; found here:

I talked with a SoftwareOutlet CSR, and they are willing to either cancel people's orders, or if you get it and are not satisfied, return it and they will give you a full refund (minus S&H of course). He also stated that due to the circumstances (that they advertised non-OEM and it is indeed OEM), they will not charge their normal 20% restocking fee if you include a note as to why you are returning the item.

So, they messed up, but they are willing to make it right, IMHO.

Shipping and handling is like 75% of the cost. They should just send a small piece of hardware with the orders.

Yeah, no kidding. We lose $6-$7 on shipping and then we have to pay another $3 to ship it back to them. Our net loss is $9 because of their false advertising.

Although I applaud that they are actually willing to do *something* - I think they should go a little further...what they did is borderline illegal if not illegal. Passing off OEM software as regular software is not a Kosher thing to do.

I received and installed it. Yes, it has a serial number and it is OEM "bundle with CD\DVD only.......not for resale.

I upgraded the latest Nero 5.X. I cannot acccess Nero Burning rom thru Nero Express......What am I doing wrong?

Ain't worth sending back to lose $5 shipping plus what it cost to return it....I'm keeping it. Have not installed the other parts.

Ordered 5 minutes ago. Then found out(through other people's posts) Nero Express is not included, and since I mainly use Nero Express, I simply do not need this. I left a message on their machine, those bastards better give me my money back!

Well, let's see if they really do make it right. It seems like they made an honest mistake, or are at least willing to take back their product since they changed the listing. Make them pay for shipping since it was their bad people and accept nothing less! I certainly hope this wasn't a publicity stunt or just a plain scam. I hate trolling, especially by faceless corporations.

Later,
Golgatha

With all said and done, we are still honoring the offer of a full refund to
you. We will credit your account back for the full amount as well as the
shipping fees back to us as well. Please make a note of it on your return
and we will administer the full refund + all shipping costs.

Sincerely,

Customer Support Team

Wow, I'm gonna stay away from this company, regardless of the deal. Even if they are willing to "correct" their error, the tone and response are completely unprofessional.

Received my Nero 6 in the mail today. They charged me $6 for UPS shipping, then had the nerve to send it via US Postal Service Media Mail, which only costs $1.42 They tried to get clever, and printed the shipping label with Stamps.com software, and hid the postage amount. I myself use Stamps.com and checked the shipping rates, to find that they overcharged $4. I've been waiting almost 2 weeks for this to come in, and was very unhappy to say the least. I was not expecting a retail box, but was not expecting OEM either. By thier description, I was expecting to get a "CD Only" from a damaged retail box, or from a customer return. I've also tried calling them, and get the same loop that others have talked about. I emailed them right after receiving it in the mail this morning, and no response yet. If I don't get a reply by Tuesday, I may just drive out there and demand a refund in person, as thier warehouse is only an hour from my house. We do all need to get together and do something about this. This is not cool...not cool at all...

Big bunch of whiny bitches. You knew you it wouldn't be the full retail software for $10.

While it *may* be illegal to sell OEM software w/out some hardware, that would depend on the license agreement of the particular piece of software. It's just as illegal to bundle this w/ a dead piece of hardware like a lot of shady dealers do. Why do they bother? Because it would be a much bigger hassle to fight it in court, so the companies don't bother going after these folks.

Suck it up. Looks like these folks are willing to make it right - even if you didn't like the tone of their message. You were a dick in your reply, so you're even.

I figured an OEM cd is okay but what bugs me is that they charged me for UPS shipping and I was expecting that and a long wait later I finally got mine in a USPS mailer. Not happy about that. Oh well, gotta email them now...

RightHere, of course we knew it wasn't going to be full retail, we thought it would be "CD Only". It isn't...it is OEM.

The customer is always right, companies need to have professionalism in their responses...I guess expecting good service is a bad thing now?

We bitch, because we were mislead. If you're happy with the OEM crap...well great for you.

What a bunch of hall monitors. You guys are the same ones who don't hesitate to try to rip off Amazon every time they have a pricing mistake. If you don't want this $70 software for $9.99, then don't order. It just leaves more for others.

Can anyone confirm or deny that this OEM "suite" includes Nero Express 6?
of course it has the core Nero 6 CD burning Rom.

But from the posts I read that Nero Express 6 is not listed on the install menu.
Other Posts imply Nero Express 6 is included.

TIA

Haven't installed it, but on the CD sleeve, it lists:
Nero Express 6
InCD4
Nero Vision Express 2 SE
Nero ShowTime
Nero Media Player
Nero Toolkit
Nero Cover Designer

Again, I don't know if it is actually on the CD, because I have not opened it. It also appears to have an original serial number, not copied, as some others were concerned about...

Maybe all the software police on this forum would like to start paying retail for all their programs and OS?

IMO its still a Hot Deal even if it is OEM, thanks OP.

Um. So, even though it said "CD Only" I should have been able to know it was OEM. And because I didn't, I don't belong at AnandTech? Brilliant deducton there SpongeBob. I guess not everyone is consumer savvy as you. Frankly, I'm moved and in awe of you, and your seniority here.

My take is this. If you can cancel your order, great. If not, it's a $13 purchase for a Nero serial number. It's not the end of the world, it's not a tragedy. In fact, relative to everything else going on in this world, it's a non-event. Take the OEM CD, use it, make a coaster out of it, give it to a friend. Forget it. Put away your guns. Can't we all just get along.........................

So, for now, it appears that we will be getting the FULL version. I hope it's true!!!

UPDATE - It is not the full version, rather it is OEM. Buyer beware...

Maybe aperry could shed some light on what everyone should have known, and when, since at least one order was placed based upon his original post.

Other than the CSR reply to Golgatha falsely alleging full disclosure, has anyone gotten an email response, or have they been stonewalled?
