This settlement was sent to my email.
Not sure how it works, maybe you can get one month free.

Part of email:

Current Netflix Members: If you enrolled in a paid membership before January 15, 2005 and were a member as of October 19, 2005, you are eligible to receive a free one-month upgrade in service level. For example, if you are on the 3 DVDs at-a-time program, you will be upgraded to the 4 DVDs at-a-time program for one month. There will be no price increase during the upgraded month. The upgrade in service level will automatically end after one month and your subscription will return to the previous service level, unless you choose to continue at the higher service level and pay the regular subscription rate for that level after the upgraded month.

Former Netflix Members: If you enrolled in a paid membership before January 15, 2005 but were not a member as of October 19, 2005, you are eligible to receive a free one-month Netflix membership on your choice of the 1, 2 or 3 DVDs at-a-time unlimited program. Your subscription will automatically end after one month, unless you choose to continue your membership and pay the regular subscription rate after the free month. If you do not choose to continue the service, you must return all rented DVDs within 7 days following the expiration of the free month or be subject to charge for the outstanding DVDs under Netflix's standard policy (currently, $20 per DVD).

ccording to the information you have provided during this Claim Form Process, you are not eligible to receive any Class Benefit. The most common reasons current or former Netflix subscribers are not eligible to receive the Class Benefit are:

* The subscriber was engaged in a free trial only.
* The subscriber entered into a paid membership only on or after January 15, 2005.

I was signed up under a different name a while ago and just signed up again so i lost out

I'll probably sign up for this. I just recently rejoined Netflix and they immediately started throttling delivery as well as acknowledgement of receipt of DVDs. I don't live close enough to one of their distribution centers to receive discs the next day but I do expect to get at least 3 discs per week on their 3 out at a time plan. I had already planned on cancelling at the end of this month's service but I might be willing to put up with their crappy service for another month if it's free. On the other hand I have been getting pretty good service from Blockbuster online and get 1 free instore rental each week.

ooooo wow.. upgraded service for one month... big fvckin deal... just one more dvd you can have queued up and not delivered to you..
I'm glad I dropped Netflix three months ago. I really haven't missed it

I have been happy with my Netflix service. I drop a movie in the mail on Monday and have a new movie on Wednesday. I have never had a problem with getting new releases....

I did try Blockbuster twice I could drop a movie in the mail on Monday and was lucky if I got a new one by Friday. The selection of titles at Blockbuster is lacking compared to Netflix. With the instore coupons, you are subject to the supposed 2 day rental and late fees.

I guess essentially what the settlement really means is that during the month of "upgrade" they'll stop throttling your account.

For those of us that signed up last year, my email said: If you still want to receive the free membership or free upgraded membership, you do not have to do anything.

Guess who really won? The Court has awarded $1,387,138, in attorneys' fees.

I use netflix and their service has gotten worse with each passing month. Is there anything better?

Their site looks suspiciously like Netflix, but they were recommended by Consumer Reports Money Adviser for what that's worth.

Are they ever going to put this settlement into effect or are they just going to continue to put it off and issue emails?

I never knew they existed so I did some looking into Intelliflix and wow I will never join.
Just do a Google on them and read the reiviews from individuals, not mags or TV shows that get special treatment, aweful. The only good review was from someone who stated they worked there. Honest, but stupid.

I will stick with Netflix. Get about 4 movies a week if I am quick with returning. Still cheaper then in store and I get all my TV shows too. To bad no adult, but I got the internet for that .

So you get one lousy month of a slightly better plan.

They must have had one crappy case against netflix for such a weak settlement. Do they even have to stop throttling? If not they could just throttle your account that month so it's like you're still on the lower plan.

A response to my email from Netflix:

Thanks for your inquiry.

In address to the "throttling" issue, let me assure you that it is almost entirely hype with very little truthy to the matter. Here is how we process and ship our DVDs:

We receive rental returns Monday through Friday, except holidays, via the United States Postal Service. We process nearly 100 percent of returns the same day we receive them. When we check in a return, an e-mail is automatically and promptly sent to you to let you know that we have received your DVD. Our goal is to ship you the DVDs listed highest in your queue from the distribution center closest to you so that you get movies quickly.

Generally, on the same day that we receive a DVD from you, we will ship the next available DVD from your queue. We will send you an e-mail letting you know when we have shipped your next DVD, including the anticipated day of delivery.

In our unlimited plans, we do not establish a monthly limit on the number of DVDs you can rent. However, as a result of your viewing habits and our operational practices, the actual number of DVDs you rent in any month may vary, and you may experience differentiated service during the course of your membership. Also, such service may be different from the service we provide to other members on the same membership plan. The type of differentiated service you may experience may include (i) the shipment of your next available DVD occurring at least one business day following return of your previously viewed movie, (ii) delivery taking longer, as the shipments may not be processed from your local distribution center and (iii) the movies you receive coming from lower in your queue. For example, your next available DVD may not ship until at least one business day following our receipt of your returned movie. This can occur when your top choices are not available to you from your closest distribution center or the number of shipments to be processed by the distribution center on that day has been exceeded. When one or both of these conditions exist, your DVD will likely ship on the next business day and may come from an alternate distribution center.

These effects will not occur unless we are faced with limited inventory at your local distribution center or when the number of shipments to be processed by that distribution center on that day is exceeded. In determining priority for shipping and inventory allocation, we may utilize many different factors such as the number and type of DVDs you rent through our service, the subscription plan you select, and other uses of our service by you. For example, if all other factors are the same, we give priority to those members who receive the fewest DVDs through our service. We believe that our operational practices, including how we prioritize shipping and inventory allocation among our subscribers, provide a great value to all our subscribers.

When we ship you another DVD we automatically and promptly send you an email letting you know that it's on the way and telling you the estimated arrival date.

Yeah I saw the "truthy" typo. I assume he must have inadvertently hit the "y" key while typing the "h".

Hell, at least it wasn't some form letter response. I was actually surprised that they took the time to give that detailed of a reply - even if some/most of it may be BS.

I had netflix paid subscription one-DVD at a time - it was effin slow, to say the least.

I had free blockbuster 3 dvd trial - it ruled, when compared to netsux.
