NewEgg Employee Thefts?????

On November 10 I ordered WIN7 Ultimate Upgrade from the Egg. I was notified of shipping from their New Jersey warehouse as I live in Virginia. Package arrived on Friday 13 November and as I was out of town I did not open the package until Saturday the 14th. It was shipped in the padded envelope as usual.

When I removed it from the envelope I saw that the shrink wrap was opened at the top of the DVD case. A closer look revealed that the authentication seal from Microsoft was also split on the pre-cut lines Microsoft uses to prevent seal transfers. Obviously someone had opened the package. I immediately fired off an e-mail to the Egg explaining the situation as there is a no return policy on opened software for obvious reasons.

A while later I decided to look in the case since it was all ready unsealed and I had removed the shrink wrap at first thinking there was no real problem since shrink wrap sometimes comes loose on the seams. I believe Ultimate always comes with two discs, one for 32 bit and one for 64 bit. The 64 bit disc was gone!!!. I immediately fired off a second e-mail advising NewEgg of this new finding.

Now I doubt, with the shipping speed through UPS that one of their employees would have had time to carry out such a clever theft and somehow reseal the the padded envelope so it appeared undisturbed (if that is possible). So obviously, someone in NewEgg's warehouse is responsible.

Question - what should I do if NewEgg sticks by their unopened policy on the outside chance I'm lying to rip off a 64 bit disc or entire software package? No one will see the e-mails until tomorrow, but I'm considering a purchase protest with Bill-Me-Later if the Egg takes the hard line rule following posture.

I might be tempted to say oh-well if I were running 32 bit Vista but I'm not - besides I pay the premium for the two disc package. What would you do???? Anyone else have such an experience???

Definitely complain to NewEgg and insist upon a new, fully sealed package. The fact that one DVD is missing is reason enough. Ultimate retail, does come with both 32 & 64 bit DVDS. There is also a very good chance, whoever opened your package, did it only to "borrow" your license code, in which case, you will have trouble getting it activated by Microsoft. You paid for Brand New, with the Microsoft COA, so you could be 100% legal. The least NewEgg should do, is make sure you get an unopened package.

Thanks for the inputs - I'm a little late getting back to you because it's Sunday and the wife and I have a church service to conduct.

I most certainly will give the Egg a chance to respond tomorrow. Finding the culprit will not be easy because anyone in the warehouse could have done this and put the package back with others on the shelf. The packer for shipment would probably be none the wiser.

It's going to be OK though.

I can't even spell nukleer.

It could also have been done by someone in the shipping chain.

Correction: There is a no refund policy for opened software. Newegg won't have any problem doing an exchange.

just tell them what you know. leave it to them to draw their own conclusions. if they see this as a recurring thing, they're gonna do an internal investigation.

either way, it doesnt pay to be an ass to them.

This. Jimmy, you have no way of knowing whether this was a theft or not, and quite frankly, it really doesn't matter. The best advice is to file an exchange RMA explaining that the factory seal was broken and some contents were missing. You'll get a new copy of 7, and Newegg will deal with the rest.

All things considered - we are all right. I never directly accused the Egg of having thieving employees, I just asked that question of forum readers to see if such an incident had occurred before.

To my surprise, received a response e-mail from the Egg today - I thought because it was the weekend there would be no one minding the store. They apologized for the inconvenience, asked for verification of my mailing address to promptly ship a fresh unsullied copy, and wanted to be sure that the shipping package was not tampered with just the contents.

If I was mistaken on refund/replace policies on software - forgive me. Like I said earlier, everythings gonna be alright. With just refunds being a no-no my whole concern is moot anyway. Like was said, the Egg will be sure to look into a package shipped unsealed with a DVD missing.

Um, you're post is title "Newegg Employee Thefts". That in fact does directly accuse Newegg of harboring thieving employees.

Not really, if someone took that disc and used that key to activate it, then it could lead back to them...

/unless they're running it for thirty days without activation...

Yes, his software did cross many hands enroute. But the most likely place for that to have happened was probably at NewEgg shipping. They probably would of have noticed if it came to them from Microsoft or the wholessaler for Microsoft (if they use one) with the seal already broken. The OP did not say, but I presume NewEgg will be including a return shipping label for the original to be sent back.

I have had issues with the shipping chain before and New Egg was great about solving the issues. I'm not surprised that they sent you new one.

To bring closure to this folks, here's the final skinny on the missing/open software. NewEgg refunded my original cost after I ordered another WIN7 Ultimate Upgrade. I did this to save time as I would have had to wait until the entire issue was resolved to receive a refund or replacement package. They have not as yet asked me to return the original package. The new package came from the same NJ warehouse through the same UPS chain in minimum time and arrived in pristine condition. It now resides in 64 bit excellence on my machine. When ever they ask for the original package I will whisk it off to them pronto no matter who pays shipping.

Oh - sending this on my brother-in-laws machine where I am visiting for thanksgiving dinner tomorrow. May all of you have a happy and glorious thanksgiving.

I'd like to thank bejesus that newegg was able to rectify the situation. I think those thieves should go to hell.
