Ha, Apple would sue Nokia so quickly... and it'd be guaranteed to win, too. Nokia (or whoever really designed this) was pretty blatant in copying the iPad mini.

Have you seen the Acer A1? That's also a blatant iPad mini clone that apparently is still available at Best Buy. Though I'm not entirely sure why Apple hasn't had a fit over that (legally at least).

Be nice if they did a European release though, I don't think that you can sue just because a product looks like yours over here.

It is nowhere near clear that Apple would win against Nokia/Foxconn. If it was a patent suit it would be different, but this would not be a patent issue for appearance is governed by trademark and copyright statues and those laws have different burdens and different purposes than patent.

Patent law is more stringent for it is designed to discourage copycats to make the person who owns the patent money (and thus in theory encourage invention.) Trademark and Copyright on the other hand are designed to protect/create brand integrity. You can't make a device that is "confusingly similar" that a juror can not tell the difference between the two products. While on the surface these devices do look similar, it would be quite easy to separate them with the right marketing, with the right boxes, with the right software so it is obvious these two devices are not the same. Trademark and Copyright do not stop copycats, if they did there would be a lot less selection of things like clothes, for all you need to do is change it enough and then suddenly clothing knockoffs are legal.

I am sorry but Apple would lose this case if Nokia does it job correctly, and if you are a multimillion dollar company trust me you have enough lawyers in house to cover your ass.

Things like the back panel is all you need to survive such a lawsuit. Image Link. Notice the big fat Nokia logo printed on the backside along with the legal jumbo. There is a reason why manufacturers do these type of silkscreens on the product even though they make the device ugly and ruin artistic balance. These steps are done to keep the lawyers happy and to prevent lawsuits.

When Nokia starts putting an apple logo on the back of their tablets, that is pretty much the soonest Apple can release the lawyers.

Was there ever a 7.9" 4:3 tablet that people didn't claim it's a copy or whatever?
You must try really hard to use that display and not make something that will remind most people of an iPad, people on TV call MS Surface an iPad even if they are paid to call them MS Surface.
And why even bother, if you keep the same button/port placement you will make most costumer happier.

Its different anyway...

Not sure if I hate it or if I'm missing something obvious.

Even their webpage is a ripoff of the product page for the iPad.

*face palms*

Now Apple does understand good aesthetic design, and there white minimalism Jony Ive look is very good at feeling warm, safe, trust worthy, being memorable, and displaying information in a memorable way. That said you have to figure out ways to make your product unique and copying a website design is a lost opportunity and just adds to people calling you a clone.

But hey Nokia is probably not involved with any design at all, instead they just stamp their name on a foxconn product and then try to sell it. When you are just a middle man often you do not have pride in your product and are okay at being a copycat.

Apple minus aqua (eg: iOS6) is a disaster. I'm sorry, but Tim Cook has already ruined the "magic" that was Steve's Apple.

And the guy is only like 52. Maybe he will die and they'll bring Scott Forstall back...one day...

It's possible to use the same display and not have the tablet look exactly the same. The A1 is definitely a copy. Almost everything is identical. Obviously the iPad Mini is a great design, so I don't mind it. Though I would like to see some more use of soft touch plastic instead of these aluminum iPad copies.

It's not a good idea to sue Nokia if you want to keep on making mobile phones. Nokia probably owns the vast majority of patents that actually matter.

lol

i like what nokia did here. yes it is a copy but its a good one and at 249 its a way way better deal than the ipad mini 3. its also thinner and lighter. apple has deep pockets and whether they win or not they would make this n1 an unprofitable venture should they release it in north america. its a pity too because this thing appears to be the best cheap android tablet to come along in awhile.
