Guess we're gonna have to start opening software, CDs, DVDs, etc. while in front of the cashier before we pay for anything so they can be witness if there's something missing, damaged, etc.

There will always be some people who will try to scam retailers, that's a given. But these measures will only result in more customer headaches/complaints. It's not a good idea to piss off your customers, otherwise they'll go shop elsewhere where the return policy isn't to strict. Of course, some people won't care, but there will be those (few?) who'll go to Best Buy, Walmart, Amazon, etc. instead.

Has it EVER occured to you that this policy will curb the chances of a customer buying a product that has missing/incomplete components? What do you mean 'without notice to customers'? Did you actively read and understand the return policy before you purchased the product? If so, as said above, you have recourse for an exchange using the return policy that you purchased the item under. You make it sound like Target has the obligation to give your home a courtesy call informing you that they've changed their return policy. That's BS and you know it. If you want to return the item you purchased, it's your responsibility to find out and understand the terms of the return policy. I'm absolutely certain that a notice about the return policy is posted somewhere for customers to find; it sounds like you've been too busy complaining here to go find where that notice is.

3) Offering little or no recourse to customers who have been victims of their sloppiness.

What are you talking about? The person at the store readily gave you information to contact their corporate office to resolve the return claim. What did corporate have to say? How do you know that when you call them they won't just send you a complete new replacement and a letter saying 'sorry'. Until you actually follow up with the instructions that the store readily gave you, I think you have absolutely no leverage whatsoever with which to complain.

For everyone else: How about in the future, when buying such products from Target, ask a clerk or even the manager what to do if when you buy the package it has missing components. If they shrug and say that you're screwed, then I guess find another store to shop at (but don't go around saying its fraud.. it's their business and you don't have to shop there.) On the otherhand, they may gave you a perfectly good solution right on the spot. The manager may even sign your receipt saying that if this is the case, they'll make an exception to your return policy.

It just strikes me that you're not even trying.. just complaining because your purchase didn't go exactly how you wanted and your not willing to spend an extra second to making it right. On the otherhand, Target is probably losing thousands and thousands of dollars to theft. Who do you think has better justification?

2) LOL Part Deux! Listen, I am not trying to make anything sound like anything! I am relating a first hand personal experience as objectively as possible. I also am trying to inform others about the risky nature of buying certain items at Target stores.

I was completely aware of the terms of the purchase when I made the purchase. On my receipt it says in bold print, "May only be exchanged for same item." The store policy in effect NOW, at the time of attempting to return a defective item is: "May NOT be exchanged for same item."

Before I "started whining" I was standing at the customer service counter gazing up at the return policy in 1024-point font occupying the entire wall and it does not say what the CS rep says is the new policy. Nor did it say that at the time I made the purchase.

3) LOL again, what is your deal?!!!!? Upon handing me the business card at 7:30 pm Pacific time the manager gleefully stated that help was available until 5 PM Eastern time (which means they had gone home 4.5 hours earlier.) I called immediately anyway just in case they were open. They were not.

This is where it gets funny.

As of this morning I called the corporate office and very politely described the situation. I was informed that Target has no responsibility for the contents of a product because they don't pack the boxes, that it is purely a manufacturer's problem, that Target can not do anything. They gave me the number of the manufacturer whom I immediately called. The manufacturer politely informed me, LOL, that EVERY box that leaves their warehouse is complete and non-defective, that either it must be Target's responsibility or I haven't looked closely enough in the box for the other disk. User error.

They did say if I wanted to give it a shot I could package everything up and mail it to them along with a letter explaining the situation. Upon receiving all this they may choose to review the letter and might send a replacement package, but they really have no way of verifying my story.


Now this is all starting to sound like a moan, but the bottom line again is I wanted to alert people:

1) Some CD/DVD/Console Game/Software packages at Target may be defective or have missing items (i.e. the product) because they put returned items back on the shelf without verifying contents.

2) If you buy such a product at Target you are screwed, you cannot return the item. Your only recourse is to challenge the credit card charge or attempt small claims court.

I can personally relate to this problem, because when Halo for pc came out several months back I bought it at Target but had to exchange it, not because something was missing, rather the cd was defective and would not install completely.
Their new policy would be totaly unfair in such a stuation.

I believe most (if not all) states have a law stating that stores are responsible to insure that merchandise is in "saleable condition" meaning that is is complete and non-defective.

I would hope that either their current policy will not be enforceable or they go out of business.

I just ran into that very problem about a software container being opened , looked like someone had opened it.
I purchased M$ Flight Sim. 2004 in the metal can. It had a little dent in the middle of the lid on the back side where it hinges.
I thought it looked a little strange and asked the manager if it had been opened and she said NO.
Some of you who have this can, you'll know what I'm talking about. The circle of tape that holds the lid down was loose and wouldn't stick very good but the Microsoft cert. of Auth. had not been damaged so I took it as it was the LAST game they had and I wanted it. When I got it home I tried to get the Disk holder out without opening the can and tearing the Cert. of Auth.
I DID it.
I think someone had copied the Disks and took it back to the store and turned it back in for a refund claiming it had not been opened. I can also do that myself just to make a point....But I WON"T.
I'm Keeping it as it was one of the SUBSTITUTE Madden 2004 63% off deals. So those kind of things do happen.
Take the software out, copy and return to store for credit.

In all my years of purchasing software and working with people that purchase software, I cannot cite one instance of this happening. My experience would number in the thousands.

I purchased Arcanum from BB shortly after it came out (was looking forward to playing over Memorial Day Weekend) - had to trade it in after the holiday because it was packaged with 2 play disks and no install disk

We had these HUGE posters with the policies on them. What a lot of people do realize is that if something is returned and was defective the retailer can send it back to the manufactureer for a replacement. You think a retailer as large as target could handle a little bit of loss. Even BB will let you exchange something if it doesnt work or is broken. so despite the fact that this may be in the wrong forum its still good to know. I never buy these sort of things form target anyway but now i will deture friends of mine that do. hope it all works out for you and thanks for the heads up.

I had a DVD shipped to me and when I opened it (sealed with Disney's authentic wrapper) and had it's security seals still on the DVD case (little PITA stickers) and when it was opened the DVD inside was funk-o-delic . The DVD had part of the label on it but it looked smeared . The bottom of the DVD looked clear like the little clear CD's on the top of a stack of new CDR's . Of course it was a error , never seen one before and none since but it was there . I could only imagine having to return one of these to Target .....

i can vouch for this topic. i recently purchased an XBox game there, and when i got home, there was no game inside the sealed package. I WAS FCUKING PISSED! tried to take the game back, got sh*t from even the manager of the store and i was refused a return, or even store credit. needless to say, i was not happy about the situation; i decided to call their corporate offices and bitched out everyone that i could. had to send the game, receipt, everything that i could find, and i am supposed to get a store gift card valued at the cost of the game, plus the shipping cost. received the gift card about 2 weeks from shipping out the game. quite a hassel for a 20 dollar game. bastards!

Can they really hold you to the new return policy? I thought when a company changes their policys that the new policys only affected new customers who purchased after the policy change and all pervious customers were "grandfathered to the old policy". Much like the when cell phone companies change their service features and the changes only affect new customers. So shouldn't target be contractually obligated to honor the return policy you purchased the product under. I do think it's shady for them to expect to hold you to the new rules when you purchased expecting the old rules.

According to the OP they just did. And looking at the initial posts alot of people think that changing terms in a contract is 'fair and square' and not cause for concern. I wonder what happens when Bestbuy or Walmart start looking at those policies and change themselves since no (edit) one (/edit) raised hell with Target.

This is a good policy, and it's great Target finally got on the bandwagon. This will slow-down (not stop) all those low-life people that like to take the product home, and copy it and bring it back. Target in my area was getting BAD with open CD's/DVD's and other stuff. Now with the new policy, I should be almost guaranteed to get a NEW, un-opened CD/DVD. If you have a problem with the CD/DVD, just call the manufacturer.

Mr. Coyote, I think you're missing the point. This is a bad policy. If they want to avoid having open CDs on the shelf they shouldn't put them there. It doesn't encourage less copying, it just screws people who accidentally buy the returned garbage Target has put back on the shelf. I did call the manufacturer and the manufacturer says it's a problem with Target.

Takes way too longer to contact the manufacturer than it does to have the store replace a defective piece of merchandise as they should.

I simple will not buy software from target with a policy like that.

Is it just me or you guys are the one that missing the point. By not letting opened software/CD to be returned, chances are less items will be missing/damage anyway. Then less chance you will need to do a legitimate return. It is becoming a chicken and egg issue, if you think about it.

Anyhow, I really hate it when they let you return opened software regardless. It only should let you exchange for the same item and it should be opened right at the spot. I saw so many people trying to return a perfectly fine disc (no scratch seen) to store, and get a brandnew one. With that he can just walk off to another Wal-mart and return it for store credit. Or sell it on ebay. The current policy is just open for those dishonest people to get around system.

This is all bullshit and I certainly will not be buying these items from Target again. Hell, maybe I just won't buy any items from them again. It's really annoying that some of you actually applaud this decision. What is the problem with allowing returns for the EXACT SAME ITEM? How does this help pirates at all? If anyone is to blame it is not the 'pirates', it is the CS staff of the individual stores for allowing a return for a different item. What sort of 'profit' is there for a pirate that can only return an item for the same item?

This does nothing but piss off legitimate customers.

I can't believe any stores allow software/CD media returns.

Good for Target then. If I owned a store or large corp chain, I would never take returns for open media.

All you have to do is open the box and check if it's there. WHAT'S THE BIG DEAL? If it's a gift, explain your situation or buy it from an online retailer. Isn't better than being embarrassed than not having the actual CD in the case when you give it to someone for a gift?


The best thing about this post is the 411 that this kind of theft is happening. But hot deal? I guess this section is becoming an informative BBB-like bulletin board. Can't there be a "Watch Out" section for this stuff? Or should I start posting virus alerts and urgent automobile recall information on this board too? How about a Whine & Groan thread? No offense, but I'm not sure how everything related to a consumer becomes a hot deal.

As far as software goes, if you ever take the time to actually read the EULA you will see that quite a few will state that if you do not agree to the license agreement to return the software to place of purchase for FULL REFUND. As an example here is the EULA from UFO Aftermath I purchased recently:

"END-USER LICENSE AGREEMENT
IMPORTANT - READ CAREFULLY:
YOU SHOULD CAREFULLY READ THE FOLLOWING END USER LICENSE AGREEMENT BEFORE INSTALLING THIS SOFTWARE PROGRAM. This software program, any printed materials, any on-line or electronic documentation, and any and all copies and derivative works of such software program and materials (the "Program") are the copyrighted work. All use of the Program is governed by the copyright law and by the terms of the End User License Agreement, which is provided below ("License"). The Program is solely for use by end users according to the terms of the License. Any use, reproduction or redistribution of the Program not in accordance with the terms of the License is expressly prohibited. If you do not agree to the terms of this Agreement, do not install or use the Program; you may, however, return it to your place of purchase for a full refund".

So if they refuse to refund your money, find a computer and start installing the program and show them the EULA. When they chose to sell the product, they agreed to the terms set forth by the manufacturer.

As far as I know, Target has never allowed a return (for refund) on opened cd's, dvd's, video games etc. This is even stated on the receipt.

They will however allow an exchange for the same item.

Well a DVD or music CD is nothing compared to what happened to me at Circuit City. I bought a Radeon 9800 Pro and when I got home it was a cheap old ethernet card. They don't want to exchange it for me so I dispute with the credit card and it's still going. This is much worse than the DVD or music CD.

Yes, I believe that is correct also.
Sounds like the new policy though doesn't even allow for an exchange on a defective/incomplete item, which, I believe is illegal in most states. ( And, as others pointed out, contrary to the EULA).

As for those of you who believe this is a good policy, good business practices for a successful store will favor the consumer's rights.
