They closed it because of flood attacks, I stopped by there about 6 times Sun. looking for info, and everytime I was there they were getting flooded, so just like everything else, the jerks ruin it for anyone else.

i am more and more beginning to feel he's lied to us the entire time. his servers are not being 'moved' there are being held in a legal quarrel with his previous dc. all of the old accounts are gone and IF he ever gets back up all customers must recreate their accounts.... ALL THE DATA IS GONE FOLKS! glad i didn't develop my two domains....geez.

Hah, http://www.cwstatus.com/ updated today - 7-15-2002 ... seems LS in Maine has all of Cyberwings machines hostage! And Cyberwings does not have any backups of the customers' data!

I hope my refund gets processed soon... been waiting 8+ days so far

We have ftp access to the new servers i believe *have to ask the owner of the account* but he says he has ftp back just needs to wait for the domain to propagate.... I dont see why everyone is so negative...

If LS was illegally holding all of the computers, any normal person would simply pay a lawyer to write a letter, or file a suite. But, CEO Shawn, is apparently either 1) too dumb or 2) HE HAS no LEGAL right to them anymore and therefore CAN'T do that! hmmmmmmmmmmmmmmm

There's no indication that CW doesn't have a backup of the data--it's just that (apparently) Lightship is holding it all, legal or not.

And remember: lawsuits can, typically do, take months or years to process, even when you have a winning case, not to mention an expense of hundreds of thousands of dollars, commonly. Not as good an option as it might appear on the surface. (A very good friend of mine is a partner in a company that was sued by a former partner. The company had an excellent case, and so was able to settle out of court for less than a successful defense would have cost--they only had to pay out in settlement and (MUCH more) legal fees around $800K. :^I What's really scary is that in America a disgruntled person can simply create these costs out of nowhere.)


I'm still digesting the Cyberwings Status page, but in the long run it looks very good, at first glance. The new prices look more than fair, and the free upgrades for OLD customers who didn't ask for a refund are simply stunning.

This look slike a sustainable model in the making. My initial concern is that they're overselling bandwidth--I bet that 100 Mb pipe will reach it's operational maximum (whatever % of technical max that is--don't know) surprisingly quickly,,much more quickly than Shawn expects. But time will tell, and if the pipeline prices quoted earlier are right, they'll be able to afford more lines without running an operational loss.

Hello! If lightship is holding it, then CW can't get at it.

I suppose it depends on what you mean by "having a backup." It seems they made and own a backup which is still fully intact, but Lightship has it now.


I don't know why people are expressing deep surprise over this, since this "LS is holding it" theory was long the obvious one to those who know what's going on. This has been the talk for days with suspicions for a week or two.

The one actual surprise is that Shawn gave the impression, obviously, that he was going to be able to retrieve the stuff over the weekend. Presumably his counsel gave him that advice, and he was very confident of it. But counsel was wrong, it seems.

It wouldn't stun me if this decision reverses in the future, that is, that LS will be forced under court order to release CW's property (that, stunningly, they even freely admit is CW property, according to e-maisl enclosed in previous posts in this forum!). But our court system is slow, as a rule (see my previous post), and Cyberwings apparently is not about to wait.


None of my comments are based on inside information--just seems like the obvious analysis, and aside from the very unfortunate (il)legal surprise, pretty much what the most cogent folks have been saying is happening all along. (But the S/N ratio of this thread is much lower than average.)
