As some/many of you know, on January 21, 2005 I was involved in an auto accident in which I was in no way at fault. I was driving down interstate 75, and got rear-ended by someone. I was willing to settle this with the at fault's insurance for what I thought was a reasonable amount.

The insurance company did not want to settle for anymore than my medical and lost wages. F Them.

Now I have had to retain a lawyer, fill out interrogatories, scheduled for a deposition, wade through mounds of paperwork, and even learn legalsleaze.

This is the pits.

I didn't read the original thread, but how much damage was done to your car? What medical expenses did you end up with? How long were you out of work?

the psycho demolished his car and hurt him pretty bad, he deserves some compensation from the scumbag's insurance company

I cant believe I agree with dmcowen674. Insurance companies and lawyers are crooks running the country dry. Politicians too.

They should be willing to provide the funds they promised to provide to their customers. But they just love the feeling of sitting on the piles of money, and they don't want to give up any of it, even though they guaranteed that certain level of service.
That's in an ideal world though, free of petty greed.

He was in a dodge ram, me in a dodge dakota. He totaled my truck. I wa sdoing 65, and he hit me at better than 90+mph. spun me from oneside of the interstate to the other. I was lucky I did not flip over. after stiking me, he the proceeded to take out a smaller civic like car, then rearend a semitruck.

my meds and lost wages were about 15K. I have a bulging disk in my neck, and now my left shoulder just drops out of socket at times.

See? And people rip on ambulance chasers. If you got a good one, he'll probably get you a lot more than you were even asking in the first place. Of course, we only have one set of facts here. But if you're not lying to us, sounds like a bad faith suit for the insurer.

Usually your own insurance company will just deal with the other guy's company, but your situation sounds a bit more complicated with the more serious injuries, you also need to take into account all the future problems related to this.

I have already accounted for future surgeries, lost wages, meds, etc.

Georgia is not a NO FAULT state. I already had my medical insurance pay for all my treatment and meds, but they are allowed to subrogate, or recover their losses.

Lets have a run-down of my insurance "scams".


1. While getting into an auto-accident I dislocate my knee. Two surgeries and $60,000 later, they paid out everything, including long bouts of rehab, and top surgeons.

2. Medical insurance? Wife had thyroid cancer in 2006, she needed to go to Memorial Sloan Kettering for her case, which wasn't "in network" for Aetna. Somehow we convinced them to cover it, in network. That saved us about 40,000, they paid for 120,000 in surgeries, tests, radiation treatment...etc.

3. Parents get into an accident with a drunk driver. Mom and dad have a comulative total of 65,000 in medical costs and another 15,000 in lost wages, all was paid.


Now, you can sit around spouting your vitriol in P&N, but keep it there. You are ignorant, foolish, and just plain wrong 90% of the time.



Ulfwald, that really sucks. I hope that you start getting some traction with them. It takes persistance and calling many people, but usually you can get it resolved. Hang in there and take care.

Wow... situations like that are when I actually am in favor of lawsuits. When an accident that's truly an "accident" happens, (i.e. roads are fine, but there's a little ice right by an intersection) I really don't favor one party taking advantage of the insurance of the other party through a large lawsuit. In your case though, go for it.

I did not want to sue, I just wanted a fair and reasonable settlement. But they pushed it way too far.

Wouldn't his under insured policy pick up the rest?

OP, Hire a lawyer its your best bet.
