The truck was paid for. They had to pay for it, it was totaled. What they do not want to pay for are my medical and lost wages. I was out of work for 2 weeks, and had over 15K in medical bills.

I'm confused. In your OP you said they wanted to pay for your lost wages and medical.
"The insurance company did not want to settle for anymore than my medical and lost wages."

I had a similar case (permanent pain) from a car accident in 2002. I figured I'd negotiate for myself and ended up pretty much being forced to accept a $15k settlement for pain and suffering (my medical bills alone were $12k).

Contact lawyers sooner rather than later. Get as much money as you can.. Insurance companies are gonna give you the least amount of money they can. It's you vs. them - and they make sure you eventually see it that way.

That was my attitude at first.. All that means, though, is they saw me as a sucker. They lied to me multiple times.

If I ever get into an accident again that's not my fault, I'm going to bleed those @assholes dry.

Insurance companies are downright evil. They force me to pay $900 for 6 months here in Florida because it's a 'no fault' state.. SO, that means that the 3 accidents that I've been in (0% fault all 3) show up on my report and they label me as a 'risky' driver.

So.. $1800/year.. I basically paid my own settlement the one time I needed a settlement - and I'm only 24.

EDIT: wait.. I'm 25 today.. yay.. cheaper insurance.

1. While getting into an auto-accident I dislocate my knee. Two surgeries and $60,000 later, they paid out everything, including long bouts of rehab, and top surgeons.

2. Medical insurance? Wife had thyroid cancer in 2006, she needed to go to Memorial Sloan Kettering for her case, which wasn't "in network" for Aetna. Somehow we convinced them to cover it, in network. That saved us about 40,000, they paid for 120,000 in surgeries, tests, radiation treatment...etc.

3. Parents get into an accident with a drunk driver. Mom and dad have a comulative total of 65,000 in medical costs and another 15,000 in lost wages, all was paid.


Now, you can sit around spouting your vitriol in P&N, but keep it there. You are ignorant, foolish, and just plain wrong 90% of the time.



Ulfwald, that really sucks. I hope that you start getting some traction with them. It takes persistance and calling many people, but usually you can get it resolved. Hang in there and take care.

Perhaps you wouldn't know how price-inflated medical coverage is in this country due to insurers, and of course its ok when they deal fine with you but suck the bloody life out of others to not pay what they have deserved through tens of years of monthly premiums.

Sounds like the Insurance co was going to pay for vehicle, lost wages and medical but from your original post it sounds like you want some pain & suffering money? I'm not debating that is justified but who is the one to say how much you get for that? You ask for A, they offer B, and you have to settle somewhere inbetween or let someone else decide for you both. So, if you have to fill out paperwork and fight for it, well, such is life. In the end you'll get paid, it's just a matter of how much. Still Sucks.

Was there some direct damage they didn't want to pay for, like a rental or something?

Well I don't know about him, but if I were to get in an accident and had no fault in it, I would ask to be get paid for my time lost at home too. If I work 8 hours per day, 5 days a week and I am out of work for 2 weeks, I wouldn't just ask for that + medical fees. I value my time at home and I can be productive on weekends, and also think of all the stuff you may be missing: a child's junior high play for example..
