Since the vicious political attacks on the NRA and gun rights in the last 18 days it's good to see that in those 18 days over 100,000 new members have joined the organization. They've gone from 4,100,000 members to 4,200,000 members. Soon it will be even more. The NRA's goal is to have 5,000,000 members before this current attack and debate is over.
“We are willing to talk to policymakers about any reasonable proposals and plans,” an NRA official said in the Playbook report, regarding the upcoming meeting with Biden. “However, the NRA is hearing not just from Beltway elites and the chattering class, but real Americans all over the country that are hoping the NRA is not going to compromise on any of the principles of the Second Amendment, nor are we going to support banning guns. But we’re willing to listen.”

Acting with an assist from CNN, right-wing bloggers and gun advocates in the know, let loose with a tidbit of information they have, no doubt, been long chomping at the bit to unleash—the revelation that there is already a law on the books that would prevent the government from making good on Biden’s tantalizing suggestion, a law that would actually prevent the government from collecting data on firearm ownership and more.

And what might that law be?

Obamacare.

That’s right—it turns out that there is, indeed, a provision buried deep in the thousands of pages that is the Affordable Care Act entitled, “Protection of Second Amendment Rights”. You’ll find it in Section 2716 part c of the Affordable Care Act although, to save you the trouble, I have re-printed the provision below for your perusal.

Did you read the entire article? even as printed, it only prevents the HHS and his underlings from gathering the data and makes it illegal for the Health Department to ban guns under the guise of "bad for human health." It doesn't stop the feds at all from passing another law in an attempt at gun control.

What one section giveth, the next taketh away. Section 2717 basically says only the Sec. of HHS can not collect the data, it does not mention DoD, Attorney General or any other government agency.

Here is Section 2717, which is modified by the above.

`SEC. 2717. ENSURING THE QUALITY OF CARE.

`(a) Quality Reporting-

`(1) IN GENERAL- Not later than 2 years after the date of enactment of the Patient Protection and Affordable Care Act, the Secretary, in consultation with experts in health care quality and stakeholders, shall develop reporting requirements for use by a group health plan, and a health insurance issuer offering group or individual health insurance coverage, with respect to plan or coverage benefits and health care provider reimbursement structures that--

`(A) improve health outcomes through the implementation of activities such as quality reporting, effective case management, care coordination, chronic disease management, and medication and care compliance initiatives, including through the use of the medical homes model as defined for purposes of section 3602 of the Patient Protection and Affordable Care Act, for treatment or services under the plan or coverage;
`(B) implement activities to prevent hospital readmissions through a comprehensive program for hospital discharge that includes patient-centered education and counseling, comprehensive discharge planning, and post discharge reinforcement by an appropriate health care professional;

`(C) implement activities to improve patient safety and reduce medical errors through the appropriate use of best clinical practices, evidence based medicine, and health information technology under the plan or coverage; and

`(D) implement wellness and health promotion activities.

The net effect is to insert a subsection in Section 2717 saying the Secretary of Health and Human Services, while implementing a "wellness and health promotion activity... may not require the disclosure or collection of any information relating to... lawfully-possessed firearms or ammunition...."

It says nothing about any other agency such as the Department of Justice or the Department of Homeland Security.

Oh yes, I found great humor in that as well. I wonder what other gems are waiting in that law? I'm sure lawyers for every major business has something in there waiting to be unleashed at the right time.

typical government crap and the law of unintended consequences. I really wonder is a pro gun congressman/senator snuck in that subsection in section 2716, and a anti gun congressman/senator saw it and change the follow on section to undo it or limited it. Would not surprise me.

When will someone think of the real victims in all of these massacres? Poor guns, always getting picked on.

I have to say I didn't anticipate the sheer avalanche of crazy that even mild hun control efforts has unleashed. There really is no nuttier lobby in America than the gun nuts.
