Cliffs:

- Obama admin did not 'give' immunity. It merely attested that Pakistan (and the ISI) is a sovereign state as recognized by the USA.

- The federal court will recognize that Pakistan is covered under the Foreign Sovereign Immunities Act.

- The plaintiffs must demonstrate that they can sue Pakistan under one of exceptions in the Foreign Sovereign Immunities Act.

- I.e., we're looking at routine court procedure.

Thanks for clearing up the trollery. That's what I'd guessed the real situation was but it's nice to have it confirmed.

This does not relate to this thread but do you really believe the following: Democrats good, Republicans bad? Please don't say it is so.

As for this thread, the US will do what they think is in its interest. India may have grudges against the ISI (warranted or not) but the US has its own agenda. After all, the US thinks it needs Pakistan so it will ally itself with it. It's all about convenience. Pakistan allies itself with China as a counterweight against India. Again, its about convenience.

I think it should really read "Obama administration says ISI has immunity" rather than "Obama administration gives immunity . . ."

Frankly I'm not all that comfortable with even citizens civilly suing Pakistan in America for crimes committed in India, even though I think the Pakistani government in general and the ISI in particular are pretty much evil incarnate. I'd rather see them petitioning the federal government for redress - not that either of the actions will do anything. Other than that, we should get out of Afghanistan, cut all aid to Pakistan, and put them on the terrorist nation list where they belong.

Excellent point, and that is an important distinction. The FSIA already existed, it looks like team Obama is merely saying the ISI has immunity according to the terms of that act.

It would be interesting if lets say tomorrow it was proven elements within the ISI were complicit in aiding Osamas hiding. (not that it would effect the OP issue)

Why not? That Pakistan is sovereign is simply a fact, he is not aiding an enemy by stating the obvious.

I am no Obama cheerleader so save it.

No, the true reason is that the ISI got the U.S by its balls in Afghanistan. The ISI is a very vital link between the Pakistani Army and the Jihadi elements in Pakistan, Afghan and beyond. The U.S. knows that in order to buy temporary peace until the end of operations in Afghanistan, it might have to feed the snakes for a while. Any kind of action on the ISI by anyone will amount to attacking the Pakistani army itself. No one can afford that and the U.S. knows this the most. If the U.S. engages the ISI directly, the situation will severely deteriorate in Pakistan because any such action will only rally the cause of the radicals claiming Pakistan as a puppet state.

It is very much impossible to separate the ISI from the Pakistani Army. They both have the same common ideological frontiers and the same common enemies. The U.S. needs the ISI for the time being, to keep the radical elements in a leash. Any attack or pressure on the ISI directly will be reciprocated with increase in the intensity of the terror attacks in Afghanistan as counterwarfare. The Americans have to pass through the Pakistani Army, they cannot touch the ISI directly, not for now atleast.

Pakistan is a sovereign state. How you see that as a negative is a mystery to anyone with an above room temperature IQ.

It's a sovereign state- what do you want him to do, deny reality? He was just stating what the facts are.

Heh I think you hit the nail on the head. The right thing to do is claim Pakistan is not a real nation until they can produce the long form of their birth certificate.
