I've been in accidents with people who thought this way.

The cop said to call our insurance companies and drove away.

*shrug*

I'm guessing in certain areas of SE MI you won't get a cop for quite a while but in other areas they show up pretty quickly. I think we waited like 15 min? Plus insurance in MI is super screwy so you want a clear who is at fault. If you are found to be <50% at fault you may not have to pay your deductible or can go the mini-tort route to get the driver to pay your deductible depending on your insurance type.

So who determines who was at fault? I sure don't want my insurance paying for my repairs if it was the other guys fault. Then my rates go up.
There's not much you can do. Unless there is an injury, most of the police in the Los Angeles area won't even respond to an accident, they just tell you to take their information and they'll take statements when you call the insurance.

Usually, depending on what the accident is, where it was located, and potential witnesses/evidence, the insurance can do a pretty good job of figuring out fault.

The same thing happened to me recently. Ok, not EXACTLY the same thing but this dickhead sideswiped my car and caused over $4000 in damage. Ok the dickhead was actually a deer, and it was my wife driving my car, but that idiot had NO right to just move into her lane with no warning. The bastard didn't even have insurance.

This is a horrible idea, then it turns into a he said she said argument with insurance. ALWAYS call the police when a traffic violation resulted in the accident so that they may issue a ticket and then dealing with insurance is 100 times easier.

Cops won't even show up to the scene of an accident here unless there are injuries. I had one stop at an accident I had in March. I was rear ended and all the cop did was ask if anyone was hurt and if we all exchanged information, gave us his card and drove away.

Interesting, in canada i have never had an issue getting police to attend, maybe its just a canadian thing.

I'm pretty sure in Canada the police just hand out tickets to deer since everyone just says "soory," "oh no I'm soory," "no I insist i'm more soory"

Because the sooner after the accident that someone *official* documents it, the more likely the offending party will admit to a mistake, not have time to cook up a good story.

For example he could have later stated that he was passing you in the left lane and you were trying to get over out of the exit lane to pass other cars that were slowing down for it. When I see an accident like this I wait around to be a witness for police... isn't that even the law in some states?

Accidents suck, but thankfully these days it's pretty fast and easy to get it repaired. Since he got a ticket, it should be nearly impossible for his insurance to get out of covering the damage, and they should cover a rental car as well. Contact his insurance and file a claim, even if he hasn't yet, to get it started.
Actually, contact your own insurance company and let them deal with his insurance company.

my dashcam has saved me before from arguments with people and time with insurance companies before.
at under $100, it's worth every penny.

so now I have to navigate MI's stupid car insurance framework.

michigan auto insurance is the worst... it is because of these laws that the average premiums there are almost twice of the average premiums in ohio

knew a guy who could have gotten his car insured in either state and went with michigan because he wouldn't have to get a front license plate. i was like "dude, it is costing you hundreds of dollars more to do that" and he was like "WORTH IT"

That's what I've done in the past but I've also been told to just go direct to theirs as it can speed up the process (which is what my GF did when she was recently hit). If there is any chance of he said / she said then yes, I'd say go to your insurance since they're more likely to go to bat for you than their insurance.

Uh... maybe where you live. I live in Michigan as well and have never had to wait more than 20 minutes for a cop to show up - even up near Escanaba. And insurance always wants a police report - always call the police.

Well he's off to the side of the road. Anyway I was reasonably certain I put a llama in my ms paint depiction of when a car bumped me while I has crossing the street at a cross walk but I can't seem to find it
