You keep saying your deposit will cover the last month's rent. Is it stated in the lease that the Security Deposit is to be used for the last month's rent?

If it isn't, you better pay the last month out of your own pocket and then have her return the security deposit to you. The security deposit is used for more than just the last month's rent. It is supposed to be used for any damages and what-not...and can be used in the event that the tenant failed to pay rent, which sounds like you're trying to do.

Dude...FVCK that.

OP: do not pay last months rent regardless of what the lease says...she already violated lease. You really think you are going to get your deposit back? If she committing fraud, and trying to change lease terms, there is likely no way she is going to hand you a check for squat without a court order. Inform her in writing to keep the SD in lieu of rent...if there is any massive damage to the apartment she can collect it from you at later date, with a court order.

You are moving because you are pissed the landlord did not wait to cash the check, you are still obligated to pay your lease.


If the check was old, as in thirty days or more, and she changed the date to a recent date, that would be illegal. I don't believe she did change the date. The 20th is still 7 days after the date she cashed it, which was still less than thirty days after you gave it to her - there was no need to change it. Don't interpret this to mean banks won't honor checks over thirty days, most do, but some don't, and none have to.


FYI holmes...

Post dating is not illegal (you numbnut).

Personal checks are valid for six months at most FI's, one year on business checks unless otherwise stated on the check.
