Its his own fault for even considering flirting/dating/wanting to date with any woman at the workplace. You just open yourself up to a huge can of problems.

But it isn't, everyone works together so well. It really is "the cool place" to work.

maybe for you... who knows how she was feeling. she might have just been laughing along to not make waves and then finally had something happen to push her over the edge.

that said, the #1 rule for any job should really be "COVER YOUR ASS." yes, that includes not making jokes that border on sexual harassment.

When you say he had "jokes"... we're not talking about shitty E-mail forwards are we? "Hey guys, listen to THIS! So there was this kid with epilepsy, right? And this Elephant says to him..."

I don't like doing this, but I really have no other choice. I just can't take the chance.

What prompted this was my remark to a female co-worker that her hair smelled nice. I had known her for over 20 years at that point. The next day she's acting very cool towards me. After doing some discrete checking around, I find that she was offended by my remark and is considering filing sexual harassment charges against me. I should say that she has a history of this behavior and has followed through in the past. None of her accusations have stuck - yet.

Sexual harassment is what the woman (in this case) deems it to be. It may be a lewd joke, a suggestive remark, that your hair smells nice, or maybe even "Good morning". It's all up to her.

I'm not risking everything on them.

You're doing the smart thing. While it would be great to joke around sometimes, it's not worth the chance. I've done the same. I limit all physical contact to the introductory handshake when meeting someone for the first time. No references to anything gender-related. No politics, religion, any controversial topics of discussion. The only upside is that if someone tries to completely fabricate something against me, I would have no trouble getting a dozen female co-workers to swear that I am all business all the time and have never, ever made even the tiniest hint of a suggestive remark. It would just not be a credible story.

The point many people are missing is that it's completely up to the other person to decide if they have been offended! It doesn't matter what anyone else thinks.

All someone has to do is say they "felt" threatened or harrassed, and the jig is up. If push comes to shove, who is going to be the fall guy? The guy who was "joking around."

When you play back the "jokes" on the witness stand, they don't sound funny any more.

There are people out there who actually try to encourage harassment so they can build a case for a nice financial settlement. We had one but the person was so obvious about it, no one fell for it.

That's the truth of it. Even if it was perfectly fine at the time, the person can decide afterwards that they didn't like it. At that point, you lose. Everyone in the office can testify that it was innocent joking, and the company will still ignore that and try to protect itself.

In these times, you have to be a little paranoid.

on the receiving end of a hostile work environment.

my last job had to have been the exemplification of it. everything was "i love you this" and "i love you that..." the one openly gay employee that we had got made fun of relentlessly behind his back.

Wow, no offense but if you consider this a hostile work enviroment, your sheltered.

did I say I considered it one? NO. But some people would. And that's what matters.

Today's workplace can be very unforgiving.

Link

I would bet that you and the OP are both under 25, am I right?

No you didn't, thus, why I said if. Your right some people would, I agree with that.

After spending time working in the field (oil), I just have a hard time relating to some jokes around the office turning into a hostile work environment.

Where I work now, I would never consider dropping the "F bomb" or making "lewd" jokes. It is a professional work environment.

My issue with this is that if you feel you are working in a hostile work environment, you either need to say something to make it clear to the people around you and work together on making it a environment everyone can enjoy or change workplaces/careers. Playing along doesn't help.

I don't think you can deem this as a hostile work environment when she frequently goes out with him outside of work. If she had a serious problem with the way they were interacting, she wouldn't be going to dinner with him outside of work.

It doesn't matter if a girl fucked the guy last night. Today she can change her mind if she doesn't want him grabbing her ass.

NONE of that matters. she can fuck every guy in the office. thats her right.

BUT if she does not want some guy comeing up and grabbing her breast or talking about it etc. she does not have to put up iwht it.

Same if one guy/girl she does not fuck talks about it and ask her to sleep with him she does not have to put up with it.

So she can complaine and sue.

No I got your point, the funny thing is other people are allowed to have a point of view as well. What I was saying was that it is BS when someone turns around one day and pulls the hostile work enviroment card and it is not just women.

Also you should check your shift key, I think it must be sticking.

Your right, if she doesn't want a guy walking up an grabbing her breast, thats her right. This situation is a far different then the one discussed in the Op...

As far as I am concerned, if she plays along, she shouldn't be able to one day turn around and without warning, pull that card.

I'm not talking about what HR would say, I'm speaking from an objective viewpoint. Seriously, "sexual harassment" claims are rarely anything related to such. If this lady had a problem with this guy joking about this, then she should have pulled him aside and asked him to stop. The fact that she did not do this speaks volumes to how she felt about it.

I work in a corporate office and we don't get away with anything here, but I've been here long enough to know that this situation would be considered sexual harassment in my office, even if it isnt really. Sexual harassment claims, are, for the most part, crutches that people can use when they want to end someone's career. Its like a reverse get out of jail free card.

Harassment, maybe, sexual harassment, definitely not.
