If this lady had a problem with this guy joking about this, then she should have pulled him aside and asked him to stop. The fact that she did not do this speaks volumes to how she felt about it.

I work in a corporate office and we don't get away with anything here, but I've been here long enough to know that this situation would be considered sexual harassment in my office, even if it isnt really. Sexual harassment claims, are, for the most part, crutches that people can use when they want to end someone's career. Its like a reverse get out of jail free card.

Harassment, maybe, sexual harassment, definitely not.

asking someone on a date....repeatedly....is sexual harrassment per the definition and could be basis for a case. Even if it was meant as a joke.

My only problem is that she never told him to cut it out. She didn't say anything to him about it. That very morning she was even talking to him normally, but then that afternoon, presumably after she turned him in, she clammed up and ignored him.

I agree, because the person in question could feel that they have to go along with the joke because that is the office place culture.

I think when the details of how she chose to spend lots of time with him outside of the workplace come to light in a court, that it shouldn't be considered sexual harrasment.

She should, but I'm not holding my breath. He was just so cheerful, he would have never meant anything demeaning or mean to someone. In all the time I've worked with him he's never been spiteful or hateful towards anyone here. I don't think this is going to court by any means, but I think his feelings are really, really hurt.

slag (a poster on ATOT.) posted "There's no sexual harassment if there is no sex". meaning only way to have sexual harassment case is to have sex.

i responded with my reply. showing that you do not need to have sex to have a sexual harassment case.

Isn't it your responsibility to come forward with the true background information on what happened? It likely won't change anything, but at least managers would get an alternate view of the situation and it could help your buddy down the road.
