While I agree that doing what you recommend is a great way to avoid being accused of sexual harassment, this chick wouldn't even have her case heard before a judge....it's likely the DA wouldn't even press charges.

Sorry, but she doesn't get to hang out with this guy for months, laugh at him asking her out JOKINGLY for months, then suddenly cry "harassment" down the line.
If she had reported him for harassment AT THE BEGINNING, she'd have a case.
And even if this one somehow made to to court, it'd be laughed out.

I agree that in this particular situation, there's about zero chance of any legal repercussions. But even so, the guy got in trouble, got written up, and may have a boss sitting there with a twitchy finger on the "FIRE HIM" button just out of paranoia. There's real consequences even though it won't ever get to a court.

We are commenting on this based on one person's version of the facts, true. But we have not heard the other person's, so this is all we have to go on, so BASED ON WHAT THE OP HAS TOLD US, this chick is a complete idiot, and IMO the company is idiotic for taking her claims seriously.

Now if this chick came in this thread and told an entirely different story, I might feel differently, but at that point, it's a he-said, she-said, and not solveable.

There are many other times and places to meet woman, the ones at work are OFF LIMITS.


AS my own mother used to say "You don?t eat and sh!t in the same place!". Maybe a little crude but you get the point. They are meant for different purposes keep them that way. The potential liability that comes in today?s work environments regarding harassment claims just makes is all not worth the trouble.

I think about all the times I've seen people ignore this rule (and there have been many)... 75% of the time it turns out very ugly, 15% no harm/no foul, and 10% good. The odds are very much against it working out which is why you shouldn't go there. There's a situation going on right now at work which is deteriorating rapidly and I'm pretty sure one of them is going to have to quit.

OK, that's fair. To tell it right it's going to be long, though.

They hired a woman right out of school. She wore fashion model clothes (don't know how else to describe it), and people were buzzing about the clothes since she had just graduated and they seemed pretty costly. A couple months later she starts dating a guy (Andy) from another department. A few months later, they are engaged. A month or so after the engagement, the clothes started to drift towards jeans and run-of-the-mill shirts and sometimes the hair was pulled back instead of carefully styled. Some guys start teasing Andy about it, as up until then she turned heads anywhere she went. Andy is a pretty narcissistic guy and the teasing is infuriating him, as his perfect fashion doll with the perfect hair/makeup and expensive clothes was now seen as merely mortal. Andy is easy to get wound up anyway, so it's not unusual for people to tease him just to see him go ballistic.

Apparently, Andy's ego gets the best of him, and after three months of being engaged, he breaks up with her. Don't know what reason was given, only that she no longer wore the ring, they no longer ate lunch together every day, and the word was going around about the breakup.

Three weeks or so after the breakup, Andy is summoned to HR to meet with the head of HR, the company lawyer, and the outside hired gun lawyer. The girl went to HR and claimed Andy had hounded her from her first week of work and then after he got "what he wanted" he dumped her. She said she felt helpless to say no since she was a new employee and feared for her job if she had turned him down since he was a supervisor and she was a lowly file clerk. Her explanation for coming forward now was this: when crying to one of her girlfriends about how Andy used her, the girlfriend told her that what Andy did was illegal and she had a duty to protect other women by blowing the whistle even though she might suffer consequences for standing up for herself.

It seems that the girl will be satisfied if Andy leaves the company. The lawyers don't believe there's any evidence that Andy harrassed her legally, so they aren't too worried about her doing anything in that sense. But this has become an ongoing distraction that is impacting people getting the work done. No one wants to talk to either one of them, even on work-related issues.

They might offer her some money to leave, or they might encourage Andy to leave (with a good recommendation and severance pay). No one broke any laws, and I'm sure they are both spinning the story for their own purposes to some degree. But it seems clear one of them is going to have to go.
