Ok the Cashiers Check cashed and the Court case against me on it

Well they just reset my pre-trial conf for next wnesday so I can consider the ple so I go in to talk to my lawyer hopefully tomorrow or Friday. Then I can get all the emails I gave her and everything else and take them to another lawyer.

On another note can anyone help me with a outlook mail access problem. I have all te old emails on another HD. I found where they were stored but when I try to access them I am told I do not have permission. How do I access office xp/2003 (Not sure which I was using I want to say 2003...) that are .pst?

Hints why I am confused as is my wife. They are trying to say because I tried to cash more then one that I was making the checks and I knew about them.

I also just do not understand what the heck they are thinking with it but I hope that a new lawyer just ends this hole ordeal quickly so that I can stop stressing over this. I mean they never wanted to see my proof, I have not been told of any evidence they have other then the cashiers check I cashed. It just does not make sense why they are doing this to us.

Def not shens sorry.

The only thing I have done wrong (And quite a few time I admit) is speeding. I have no criminal record beyond traffic tickets.

ok... I had it verified and they told me it was good. After that I did cash it and send the items believing the place I had gone to had done the through checks that a large chasiers check requires. (If you buy 3 powerbook ti g4's thats 1200 a pop plus shipping, an amount of that much would make you check it thats for sure, just like I did).

And since I am out 3 laptops how did I make any money?

Were the checks in you or your wifes handwriting? There is not enough evidence in the case to put culpability on you. Cashing 2 bad checks is not enough to prove fraud. There must be more to the story.

No they were cashiers checks. Would a pic of the one that I did not cash help? They are both bank type generated I guess is what to call it. They have been printed by a check machine or so I would believe since from what I was told it takes spec fonts which you have to pay for to print checks. (Nicker fonts?)

Maybe already asked but...

You can't afford a lawyer - you were working at the Texas Roadhouse as a server with your wife - how can you afford to buy and sell laptops?

Check cashing places are the scumm of the earth. I wouldn't consider a check cashing joint an authority on the validity of checks - I can see why the cops don't buy this part of your story. Why not use a bank? If you had doubts put the $$ in an account and wait until the check actually cleared?

I used to use cashier's checks all the time for ebay stuff... this is just scary. I alaways thought that once the number appeared in your bank account that you were golden. I learned something from this thread.

I had been buying and trading laptops for some time at that point and had just sold my 2 rx-7s (1st gen) that I never finished. Thats where my funding for it came from. Hope that helps in some way

I guess I am having a hard time figuring out what the case they have built against you consists of. They need irrefutable evidence that you created the checks in order for them to pin a felony on you. Oh, and like everyone else has mentioned.....get a new lawyer. Right now. Whatever you are doing at the moment is not more important than calling every lawyer in the phone book and getting legal advice.

I agree I have already talked to a few but they all want to see the information my current lawyer has so I need to get that so they have the information they need.

Here comes 2006. Don't trust a personal check, cashier's check, and for God's sake don't take a reversable paypal payment from a hacked account. Don't give your garbage man a check, he'll alter it. Don't click that email, it's not from eBay, but boy it sure looks like it is.

Hell, close your browser now, there's an exploit being used in this post. I got your credit card number while you were reading this.

Bro, they have to PROVE beyond a reasonable doubt that you did one of the following:
1. Made the checks
2. Knowingly attempted to cash the check even though you knew it was phony
Tell your lawyer that. If they can't prove that you knowingly did something wrong, they can't do shniz and you'll demolish them in court. They're going purely off some circumstantial BS that makes it LOOK like you did. But, it's innocent until proven guilty. You're assumed innocent and NOT guilty. You have the benefit of the doubt, and if they can't prove #1 or #2, you win. Game over.
