public intox and shoplifting are in two different areas... A background check doesn't just say "misdemeanor", it tells what the charge was... I'd have no trouble hiring someone who had a "public intox" when they were 19 yrs old... sometimes that goes with the age... I'd just chalk it up to partying on the weekend at college. Shoplifting on the other hand... I wouldn't hire someone who was a thief. Period.

Sorry to hear about the situation that your girlfriend got arrested for. I'm sure that the process of being arrested and having to go to court is a very humbling experience. I'm sure the two of you will be able to put this whole situation behind you shortly so you can continue on with your lives.

As for all you people giving half or one sentence responses, shrug. I have nothing to say to you. I expected as much from ATOT, but I figured I would at least get a couple good responses.

if you don't have enough money for a lawyer then you need to go to a public interest law firm. there should be alot of them on the net in your area. they'll charge a fraction of what a usual attorney charges and some will help you out for free. look for the ones that do criminal law. if you still can't get an attorney then your best bet is to plea bargain. she seems like a good kid and its only $10 worth of markers so you should be able to get probation or community service + fine really easy.

Wow! I missed this thread. You never know even people you live with and think you know very well. This life is unpredictable sometimes.

If she had the money to buy the markers, and if she's telling the truth, then she may have done it because of a feeling of entitlement or an impulse. Usually, that kind of behaviour doesn't stop so fast. Nevertheless, I hope she never makes this mistake again.

If I were you, I wouldn't be worrying about fines. I would worry about how she could ever get her record expunged, in the event that she pleads guilty or gets convicted (which will likely happen). Since it's normally classified as a misdemeanour, she'll not be able to expunge it. (I may be wrong, though.) The sad part is, this will haunt her for the rest of her life, especially if she pursues any careers that would require working with or around kids. Furthermore, she may get rejected silently or in letters because of her background; the employers won't tell her, though. Nevermind! I see she isn't a minor. This was an extremely bad timing. . . .

To be honest, unless this is really a unique case with extenuating circumstance, you will not find a lawyer willing to take this to the end. They'll likely tell you her to plead guilty . . . not to waste the court's time, etc.

I say this from the experience of someone I know in real life, who had no prior criminal records and had shopped a lot at the store in question. I wish the person had the favourable experience some of you make it sound like.

It's still a midemeanor, regardless of class. Realistically it has little affect on your employment opportunities. MABEY if you are applying at 7-11 for a overnight clerk position.

I've been through court for more than my fair share of things. To be perfectly honest, shoplifting was one of them at one time. Though, that was when I was a minor, so totally not relevant. After that there were others. No details need to be given.

After all of this, I was still able to be hired by a government laboratory and given a security clearance. Roughly a year after the last incident.
I have never needed to claim I was ever convicted of a crime, nor has any employer ever asked.

Working for people? Don't you essentially work for people whenever you work? How do millions of citizens convicted of misdemeanors work for people? How is it that there are so many people of all walks of life convicted of misdeameanors, and their lives arn't ruined?
The felonies are what count.

It can be expunged. If my dad had a felony drug posession charge expunged, they should have no problem with petty theft.

She's going to go through any programs or whatever they have to get the lightest sentence possible.
