Yes, an inability to establish willful intent is usually hard in these cases, which is a big reason why many are not prosecuted. In this case the suspect has publicly bragged about his explicit intent to keep classified documents for his own purposes even after the government demanded them back.I do have to admit that Trump has done a pretty amazing job of establishing his willful intent to do the things he did.
