Boo Hoo WAAAHH: I got the cancellation email finally.

Now I'm going to sue:
1. NECx and Gateway (of course)
2. RCraig (for posting this non-deal)
3. Anandtech (for allowing this bait-n-switch so-called "hot" deal)
4. Anand L Shrimpi (I'm sure he is worth quite a bit)
5. Casra (cause he likes to be in court)
6. Myself (for this total waste of time)
7. My mother (for giving birth to me)

Well..the plot thickens...

I just called NECX AGAIN...and "Pete" admits there was a pricing error and that MOST of the orders were cancelled. However, he also says that my order (status: Product Shipped), DID IN FACT ship! He says a few got through. So, if your status says "shipped" it probably did. He adds that though there is no tracking # yet, it WILL come into his internal system (and the web) eventually, probably 24-48 hrs.

Fingers sweating from being crossed for so long...

"Slipping through" meant that it will come at $38.95. They CANT charge your credit card for more than you authoirzed on the order form.

Hey, go check out the story at HardOCP - Gateway reinstated the orders from the geforce4 misprice after so many complaints. Think there's a chance that'll happen here? Maybe we should keep whining a little longer to them...

This GF4 deal was a totally different situation. The GF4 was not a misprice, but a perceived product availability problem by Gateway/NECX. It was Visiontek that finally admitted that they mislead Gateway/NECX and promised to give them priority fulfillment of those cancelled orders. With the M515, it was an obvious price mistake and was identified as such by Gateway/NECX.

they can't legally do it, but companies have charged me more than what I authorized on the order form in the past. I guess they just assume that most people will just let it go or something.

Status is still "product shipped" but no tracking number or credit charge pending. I read on their website that it takes 1 business day to add a tracking and that the site should be updated midday tomorrow. Crossing my fingers but I don't expect anything.

Product Shipped status remains with no tracking number. I have called them twice, and both times they claim it has shipped, but couldnt provide me with a tracking number yet. Still a hold against my CC. I think tomorrow (Monday) will tell the story...either we will get tracking numbers added to the website, or we will probably hear nothing and get nothing...

I just spoke to them again (Monday am), and they still assure me that I am getting one. The rep called the warehouse directly and they said it was supposed to ship on Friday, but because of "power" and Computer problems, all their orders from the Gulf Coast (FL) warehouses were delayed and won't ship till today. He says that's why no tracking number has appeared yet. When I compalined that I paid for Fedex shipping, his comment was..."well this is a $400 item that you are getting for $40, so I'm not about to add anything else to your order." (In other, he was NOT feeling sorry for me). He said there should be a tracking # later today or early tomorrow, but that he VERIFIED with the warehouse that the item has been "released" to ship and will do so today.

I'm assuming there are few of us who are in that "lucky" status at this time. Maybe as few as the two you have identified....

This makes no sense to me. So they are fully aware that they are planning to ship your order at a loss, and they have not tried to stop it? Even if UPS had the box in transit, necx could still recall the package mid ship if it was in their best interest. Is there some deal that you have made with them to get this status?

This seems an odd move on their part.

Well, my order page still saying "Obtaining credit authorization", and the second page says "Shipment Pending", the charge still been "pre-authorized" on my account, and I had 10k+ of credit line in my account, so the "Obtaining credit authorization" is obviously false. I ordered two of them for total of $86.15, my order number is 65782****, I think I order it way after those two people here said their order has been shipped. Well, I am not expecting anything, the longer they hold that pre-authorized charge, the better chance I can argue with them, I think...

of course it makes no sense...just as it going up on ther site for 38.95 made no sense. Someone goofed. if their goof is my gain (and maybe some others), then great. When I actually have it in my hands, I'll let you know..

I'm not trying to crap or start war, but if it was me possibly getting this, I would be hiding in a closet, not calling and emailing and certainly not complaining about paying xtra for "fedex." IMHO you're looking to kill the deal for yourself. What's to stop this guy from scoring points with his manager for bringing this obvious mistake to his attention?

Exactly. According to my bank (MBNA) "temporary" charges can be made in order to test the validity of the account. They are held against your balance until they are fully posted, but if they are never posted, the charge sticks for 30 days before they remove it, but you don't get billed for it.

In other words, NECX released the charge, but MBNA won't for a month.
