Im kinda pissed. I ordered one not expecting to actually receive it but by the same token they were sure damn quick to charge my account! I show a withdrawl for the $46.70 amount for yesterday and got the email last nite. Lets see how long it take them to correct the error.

I also agree with the others who mentioned that they should just come clean and admit the pricing error rather than claim OOS and relist the item at a new price.

Right now my order says Shipment Pending. I am just WAITING to get that email saying they are out of stock. It will be immediately forwarded to the BBB online along witha complaint for false advertising. Granted, no company should lose money on a mistake, but because of the mistake they should either 1) ADMIT they made a mistake 2) Offer to send something else in its place. Merely saying we are out of stock (form letter) doesnt cut it and shows no regard for the customer. Same idiotic problem I am having with Compaq. They will only respond when their reputation is threatened, and that can be done through the Better Business Bureau. Sounds wimpy...but it gets action.

I agree guys. I got sick of hearing people pee and moan about why weren't they sending them out? Their fault, they should honor it!!! That's BS, but I do agree that they should admit they screwed up. If they wanna treat it like BB, and send out GCs, fine. If they wanna say, "Sorry, we suck." , that's fine too. But at least say it.

Don't know about the BBB, but getting a petition together, for everyone that actually bought one might be a good idea.

BTW, I haven't received an email yet like some have, and my order statement still says Obtaining credit authorization, so don't know what is going on.

i really hate NECX....... they have screwed me over two or three times now in the last 45 days..... i am going to pursue them about my orders etc until i get them via email and phone, and if they refuse to reinstate my orders, i will be taking them to court, that's it, had enough bullsh1tting around...

anyways a friend just had a funny idea, though i doubt anyone will do it -- use the "order confirmation" emails and webpages to try and get someone like CC or BB or whoever to pricematch......

i didnt order one of these, just read the thread cuz it sounded interesting... you guys should TOTALLY flood them with emails asking why, if it is out of stock, they have it listed on their website and showing as IN STOCK. and i would certainly suggest forwarding your OOS emails, along with the above webaddress to the BBB and CC: their customer service department. price mistakes are one thing, and they DO have the right to say it was a pricing mistake and cancel your order. however, to flat out LIE about the situation is WRONG. :|

This item is no longer available from the manufacturer and will not be listed on our site in the future.

Somehow I think that a company shouldn't lie to your face and tell you the product isnt' avaialble any more when it's a brand stinking new product. If they would have said they screwed up and can't honor the price, that's one thing, but to say that they can't get it anymore, what a crock.

Don't worry....
Demanding them to take a $300 loss on an item like this and claiming that "nothing less will be acceptable" is simply ludicrous. Trying to claim discrimination in a faceless online transaction is equally ludicrous.
It's definitely correct in calling their lie, which is what mine and my coworker's e-mail said, but if you want even a remote chance of getting something out of this, you've got to create a win-win situation. In this case, I would imagine a company like GW/NECX would sooner lose our business than donate hundreds of m515s to unscrupulous bargain hunters for %10 the real price.
If you walk in and say "I DEMAND! I WANT! YOU OWE ME! YOU CHEATED ME!"
You usually get "Take a hike."
If you walk in and say "I'm extremely dissatisfied and I'd like to work out a situation in which we both are satisfied..."
While they still might tell you to sod off, they're far more likely to say "let's see what we can do..."

is this an issue better handled by the bbb or by a class action lawsuit?
like everyone else has been saying, it is one thing to come out and say they made a pricing error and then cancel, but to actually lie and say its out of stock when the opposite is true is an entirely different story

on the flipside, has anyone *not* gotten a cancellation notice? its possible a couple palms slipped out the door...necx fulfillment is normally very fast

Jesus H. Christ, when did this forum turn into a bunch of whiny, immoral, self-important pricks with intent to defraud and sue? It didn't used to be this way, but now every price mistake thread has degenerated into "us vs. them."

There is a difference between a hot deal and an obvious price mistake. I can't blame those of you who ordered, figuring, "it'll be great if it actually comes." I've jumped on a few opportunities myself. But the bottom line is, the company doesn't have to offer you jack. You'd cancel the orders too, if it were your business. To those of you screaming "lawsuit!", why not focus that effort and energy on something important, like your friends or family.

Although my hope is dwindling, I have not gotten the cancellation notice--yet. I am still "Shipment Pending".

I also agree that any lawsuits are frivolous and a waste of time. Enjoy when a decent company makes a mistake and actually follows through with it, but don't over react when a not so decent company doesn't. Just don't do business with that company and spread the word. That is the greatest damage you can cause.

My 2 cents.

Look if people just get into name calling, or bitching about how to get back a necxdirect via BBB or Lawsuit or what ever this thread will get locked just as fast as the Best Buy threads did after the orders were canceled.

KEEP THIS THREAD ON TOPIC.

If you have information to share on your order status post. But don't bitch or discuss legal action.

We all know its a price mistake, and only time will tell how they deal with and fully resolve this matter.

Until everybody is canceled, this thread is still about the deal.
After everybody gets canceled, then discuss how to get back at them.
