Call them and say:

"Hi this is PapPap. I will come in on X date to pick up my final paycheck for the amount of X. If there is no paycheck for my on this day, my next trip will be to the county courthouse to file a small claims case against you."

So the guy's business is fail, and instead of fucking your wife, he makes good on his employment contract with her and pays out of his personal checking account, which you get tax fucking free, and you go and be a rat? So yes, you are.

No "tax free" money was received. The guy didn't send out a W-2 for her wages and withholding. That put us in the position of having to fork over the tax dollars out of our pocket. fuck him. He was SUPPOSED to be paying payroll taxes. That's his job as a business owner. That's an implied part of the "employment contract."

Of course, IIRC, you're one of the "anything a business does is ok" posters here.

Thanks for the replies everyone.

I have never received any payment from them before, ie. this is my first and only paycheck in queue.

I am still trying to figure out what to do. I'll probably be 'nice' one last time, and if they still give me BS then I'll tell them they have X amount of days to mail me a check and if I don't get it I'll take them to small claims? While I do want more than anything to get my check (the principle, not $), I also do not want to 'incriminate' myself anyhow w/ tax problems. Like I've already said I will report my earnings etc, but are there any other things I can get in trouble for that I would need to do?

Also, I think once the guy claimed an accountant does the paychecks, so if she's real, wouldn't she do the taxes? But if us employees never get any forms or anything, then it's illegal IIRC.

And to whomever asked what exactly they say when I ask, it's too much to type out and there are too many variables and experiences I had when working that raise big red flags.

Lastly, if I do end up giving them 'motivation' to send me my pay, should I do it in person or email/writing?

You put yourself in the dumb ass position by telling the IRS. Someone hands you a personal check and you go report it on your taxes. Who's the idiot?

I have the IRS on speed-dial. Whenever I get a personal check they are the first people I call.

There's a big difference between not reporting small time gambling winnings and not receiving a proper W-2 from your employer. Your troll is weak.

just because someone pays you with a personal check does not mean they won't turn around and W9 you to their benefit. Then YOU have to explain to the IRS why you failed to report income.

First...In some states I think you can report a business evading payroll taxes and receive a portion of the back taxes recovered as a reward. Just go to the IRS and/or state tax board and tell them your story. They will help you get paid and go after the business.

Second...JS80, your mom called and said for you to stop posting because you are just embarrassing yourself.

The gains you made by not paying taxes are probably greater than this loss of pay, so if you don't end up getting paid you still come out ahead.

not a bad idea if both the employee and the employer can agree on this, but it can't be a one sided deal and it's against the law to not give someone credit for their paid labor.

yeah...under the table means you lose most, if not all, your rights. It does not matter if you are willing to pay taxes for it now.....you already evaded the taxes.

Not really. It really screws the employer over more than the employee. I would call the State or Federal labor dept. Taxes is gonna be an issue, depending on when you claim you were working there...you haven't really evaded taxes, yet...still could claim you thought of yourself as a 1099/Independent contractor...I would start threatening to go to the State and Federal Labor Dept to the Mom and Pop...it would hurt them way more than it would hurt the employer.
