Since a lot of law operates on precedent couldn't Snowden use this to stay out of jail?

Much information is over classified.
where it should be classified as Not for Dissemination or ITAR, gets classifed as Secret or TS. Confidential level should suffice; however, everyone rather than using common sense always errs above and beyond.

Except that, in this case, the stuff he gave to his mistress included

“classified information regarding the identities of covert officers, war strategy, intelligence capabilities and mechanisms, diplomatic discussions, quotes and deliberative discussions from high-level National Security Council meetings, and defendant David Howell Petraeus’s discussions with the President of the United States of America”

Seems to be way above confidential.

The actual double standard is "rich and powerful people are above the law, poor and powerless people get crushed for suspicion of having a joint," but I'm sure this thread will instead turn into "Obama did it!" vs. "It's stupid to pretend this case would be any different under any president."

I tend to think this is more carelessness than anything else. I don't see how this relates to Snowden or anyone else convicted of passing classified documents where the info fell into unfriendly hands. His classified info seems to have not been leaked to anyone anywhere (aside from the biographer).

I think we need some more info. I don't understand how classified info would help her write the biography. I don't readily see why info needed for a biography would be stored with classified info. Does he keep his baby pictures and high school track team awards tucked into a binder of national secrets? Since he had already retired, why did the Obama Admin not relieve him of this classified info?

I don't disagree that the wealthy etc get breaks we don't.

However, given the info at this point what he did seems seems very trivial. Were he a Dem would he have even been investigated/charged? I wanna see someone make that argument.

BTW: This appears to be the law:

(a) Whoever knowingly and willfully communicates, furnishes, transmits, or otherwise makes available to an unauthorized person, or publishes, or uses in any manner prejudicial to the safety or interest of the United States or for the benefit of any foreign government to the detriment of the United States any classified information—

Based upon what is known at this time, he merely seems negligent. The above appears to me to require much more than mere negligence.

And I still wanna know why this administration allows a retired person to retain classified documents. Your average business wouldn't allow this and has established procedures to ensure it doesn't happen.

It's just sad. I feel badly for him, all the way around. There was no malicious intent. Anybody who ever let the head of their dick do the thinking instead of the head on their shoulders should have some sympathy.

Eh, I'm fine with this double standard. The average joe hasn't done as much for the US as Petraeus over their life time. Sure, he made a poor choice, but, damn, the man is a four star general.

Petraeus has said he is an independent, and hasn't voted in a decade or so. He was also an Obama nominee.

Such a Schmuck. The only reason Broadwell lacked the proper security clearances was because she was ex- rather than active military. In that, Petraeus was technically incorrect.

Obviously, we need to bring back the old time goodness of traditional punishments for such traitorous acts. He should be half-hanged, castrated, disemboweled, drawn & quartered, his head put on a pike on the Whitehouse law so the crows can pick it clean.

It's all Obama's fault. He never does anything right.

Four star generals get these kinds of passes; mustn't embarrass the voting bloc / power brokers that is the armed forces.

First, Snowden's case is nothing like this. Patraeus did not pass secrets to foreign govts etc.

Second, you might to bother with actual facts: He hasn't gotten off with a small fine. He hasn't even been sentenced yet. He could possibly go to prison.
