They work for me, and I do agree that he did a pretty lousy job.

They work for me, and I do agree that he did a pretty lousy job.

Good! It's reassuring to know that I'm not the only one. It's actually quite embarrasing and I've had a couple neighbors make comments to me about it.

Yeah that's pretty bad. Looks like it could have been a nice fence if the guy hadn't done such a shoddy job.

that is one crooked fence

Is the picture of the door open showing that it can't open all the way? The way I'm seeing it, it looks like it is dragging on the grass.

Don't know much about the legal issues.

But LOL at that fence. How anyone could think that was an acceptable job is barely believable.

Yes, thats as far as the gate opens. If you look closely they didn't even PUT A LATCH ON THE FRICKIN GATE! :Q

Lol, that's what I said. Yeah the neighbors have commented on it.

I mainly want to sue him for the cost of removing/disposing the fence but do I have any grounds to sue him for more? Maybe I'll see about getting his contractors license pulled or something. Honestly before all this, I was wanting to give the guy an opportunity to do the right thing but he has tried to turn this all around onto me and now I have no sympathy whatsoever for the guy.

Who ever he hired tio build that fence hasn't a clue on how to build fences. Definately take him to Small Claims Court, with those pics as evidence you have a Slam Dunk case against him

The thing that is pissing me off now is that I have this horrible fence that I want torn out ASAP.

If I do a claim and/or this guy sues me and I decide to tear out the fence beforehand, then I've lost my physical proof of the workmanship. Someone suggested that I do a video walkthrough of the fence in addition to the pictures I've already taken. Would this hold up in court?

Since i haven't paid anything, at this point I just want a new fence put in.

Oh yeah. I'd complain to anyone who'd listen -Contractor board, BBB.

Show 'em the pics.

I doubt you can get much more than him just removing the mess. (I don't see how it can really be repaired). If you want more, you're likely gonna have to get a lawyer, or at least talk to one. Damages can sometimes be trebled (tripled), but I don't know under what circumstances or how you'd quantify the "damage" (other than removal fees and reduction in home value from that mess).

Good Luck with it and try to learn from the experience. I'd be inclined to show the photos to the next guy and make sure he understands that crap won't fly, etc. Maybe be on site while the work is performed (including if he does removal. I can forsee gaping holes in your lawn where the posts have been removed).

That's not exactly true. In the real multi-million dollar contract world (in Canada at least), a bid by a contractor is the Contract A. Unless there's a stupid error to void it, the owner can sue the contractor for backing out just by bidding. "A bid is acceptance" got nailed to our heads in the course. However, obviously these super-professional ones are done in the presence of high priced lawyers...

Anyways, my god that is a terrible fence. Too bad you didn't get a copy of the original contract. These guys really are C-suckers. Had work done last year, family didn't get ANYTHING in writing, so there were BS charges and poor workmanship everywhere. If the guy altered the contract and you didn't sign off, there's gotta be someway to prove that. Too bad your job wasn't a multi-million dollar one; owners usually require contractors to get someone(lien/insurance, don't remember term) to make sure the the job is done properly or this someone has to pay.

Think your best defence is to get that contract back. Jackass isn't responding, so if you think it's worth it, get a lawyer to do it.

This was my experience in small claims court a few years back. I sued a driveway contractor for shoddy workmanship and wanted them to redo the driveway. In a nutshell, most small claims court judges favor the local contractors and yes I was told this by two lawyers. Sure it's unfair but that's the way it goes. Second, since you didn't have a written and signed contract you can only sue for the poor workmanship which is evident from the photos. The height issue will be tough without the contract. I hate to say it but I believe the judge will rule that you pay a reduced fee which he will decide upon. This is what happened in my case. My bill was $1850 and the judge ordered me to pay $1100. The judge commented that the contractor did do the work and supply the materials which he takes into consideration. Under no circumstance should you tear down the fence or pay to have a new one put up until you have your day in court. The height issue is quite unfortunate and you may be stuck with the 5 foot fence. One other suggestion, call your local building department and speak to them about the 5 foot fence and see what the permit says. If it says 6 feet get a copy and bring it to court. You might convince the judge the contractor was 100% at fault for the wrong height and possibly get off paying for the fence.

Any contracts for goods over $500 usually have to be in writing. I think it is safe to assume that the materials for the fence were over $500 so any 'contract' may be voidable.

I think that when you receive the letter from the contractor's attorney you may want to reply back or the attorney will probably get a court judgment against you.

I don't understand how getting a family member to file a prior lien would help you. As far as small claims court, I believe you can take an attorney with you.
