Ok, I wanted to keep you guys updated.
So I called Gigabyte Customer Service today and they told me the motherboard was shipped back either yesterday or its in the shipping department today.

The guy was really helpful, so I asked if they found the problem and he told me it was a bad CPU Socket.

I was worried because I was reading awful reviews about Gigabyte RMAs while I've been waiting.

So when I get it back I will let you guys know whats going on.

well got the board, and no changes.
Things are actually worse now.

Im still having random crashes, terrible fps, cant format windows or install crysis 2, getting weird errors, and memory misreadings.

The CD drive also does not work anymore, it loads things for a while thing just stops.

This is the worst problem i have ever had. Im going insane. I have no idea what the problem is and dont want to go out and buy a new baord if thats not even the issue.

And i dont want to take it to a pc store because they will charge me $150 to tell me the things i already know.

I feel like i just wasted alot of money.....

Also im hearing all kinds of weird noises
Especially soon as i turn the pc on, also i started one time and the fans were all spinning extremely fast.

I hooked up my old psu and hd and nothing.

Is this a replacement board, or the same board (refurbished)?

same board, apparently it was "repaired" but i have a fealing they just received it, used the box as a stand and sent it back.

or it was repaired and the mobo isnt the problem?

also i find it a little weird that in speedfan i have a -128C reading

These are idel temps
GPU:33C
GPU:26C
Temp1:28C
Temp2:35C
Temp3:41C
Temp:-128C
HD0:22C
Core 0:40C
Core 1:40C

not sure if its related but thought i should share.

Also when i use my head set i hear the weirdest noises.
The only way i could describe it is as if im hearing the motherboard running.

It just sounds like screeching, and changes to different actions
for example, when i scroll up or down i just hear a long screetch from the headset
but if im just moving the mouse around it will be little beeps and screetchs.

Sorry if thats not too clear, but its hard to describe.

Download RealTemps instead, Speedfan hasn't kept up with the technology so it doesn't work with a lot of newer boards.

Sounds like more than one problem. Is it possible the bad socket damaged the CPU? I had the same sort of sound issue, it turned out to be a bad sound card.

SpeedFan is fine. It just looks for sensor readings, and attempts to label the ones in recognises (GPU, CPU, Core 0, etc). Use the Configure button to access user-modifyable readings, to rename or disable incorrect values. It's just a piece of software designed to handle generic inputs.

Hmm, there was an issue with some of the LGA 1366 sockets. I don't think that it could have damaged the processor, but you can never be sure. Can you run Memtest overnight to check for memory errors?

ive already ran mem test and prime 95 over night with no errors.

My guess at this point is either gigabyte didnt fix the board or the ram and mobo just arnt compatible.

A family friend is currently working on it, he has the equiptment so hopefully he can determin the problem by tomorrow.

Sounds about right, though I would have thought memtest would show incompatible memory. Hopefully your friend will have an extra module to test out. I'm sorry for your bad experience, I did go through something similar in the build before my current one. I think that's why I kept it so long, once all the drivers and issues got straightened out I was loathe to go back and build another.

So the family friend says hes not seeing many of the problems ive described. He says the only problem he can find is the memory misreading and he thinks its caused because my ram isnt on the support list for gigbyte.

But what about the bad fps in black ops?

Anyhow, i guess im going to try and buy some new ram.
I want a good amount, atleast 8gbs and for not too much money, $100 range
This is the support list
http://download.gigabyte.us/FileList/Memory/mb_memory_ga-x58-usb3.pdf
And this is the memory i was looking at
two of http://www.newegg.com/Product/Produc...9D3K2%2f4G

^ I would recommend NOT buying that set of ram.

Get something running on 1.5V and get a 2x4GB set instead of 4x4GB. Uses less power and leaves room for future upgrade. I wouldn't rely solely on the list, since they only test a few sets of ram when there are almost limitless choices on the market.

How about this?
$75 after promo code - G.SKILL Ripjaws X Series 2x8GB DDR3-1600

I dont think those are on the support list.
Theres actually not many 2x4gbs available on the list

would i be better off getting new ram or just getting a new sabertooth.

Also, this family friend, aswell as my friend, both said they havent seen any problems with the pc besides the missreading.
I know im not hallucinating, the pc is not running how it was. And how can you explain the terrible fps happening now, if im just imagening something is wrong with my pc?

EDIT: Ok, so im really thinking about just buying an asus sabertooth.
I was looking at the mem support list and my mem isnt on it but there is one that is very similar
Heres mine, which is not on the support list
http://www.newegg.com/Product/Product.aspx?Item=N82E16820231310
and this one is on the list
http://www.newegg.com/Product/Product.aspx?Item=N82E16820231274&Tpk=F3-10666CL9D-4GBRL

I Dont want to buy the sabertooth and still not have compatible memory.
but the mem is almost the same just i have 8gbs 2x4gbs instead of 4gbs 2x2gbs

This. The compatibility list is simply a limited range of memory kits that have been tested in-house. It would be nice if they bothered to post an "incompatibility list" of the few memory kits with correct specs that fails to work.
