and ley me guess: she wasn't charged with throwing our her ticket? god damn bitches. the oficer did his job and the bitch argues with him! i can imagine he annoyed he must have been.

:roll: What in the name of God does being annoyed have to do with physical roughing someone up? Absolutley ridiculous. She threw a fricking ticket out the window. BFD. The officer simply should have wrote another ticket for littering and kept writing them until she stopped throwing them out the window or arrested her for disorderly conduct after the third or fourth ticket.

Also, didn't the officer know that he was being filmed by his car?

He should have written her a littering ticket and then tell her that there's no point in throwing away the ticket since he's got her information already.

Actually I mis-quoted him. He said that "unless you are 100% sure that you will blow a 0.0" (i.e. you have not drank ANYTHING in 24 hours), do not take any tests. Basically this is preventatory, in the case that you are actually slightly over the limit.

He also said that if they are able to tell without medical tests and they have multiple witnesses (i.e. you can't walk or stand up, you are puking, you are slurring horribly, etc...), and ESPECIALLY if they have video of you doing this and/or have a medical witness (nurse/doctor/M.E./E.M.T.) of you doing this, you will probably get convicted anyway.

I don't expect people to like it, but a defense attorney's job isn't to keep the public safe or achieve justice for society. It is to protect one person: his client. If he does anything less than that, he's committing malpractice.

I've been hassled by cops. I wasn't happy about it at the time. Then again, I deserved it. I knew it then, but wasn't mature enough to admit it - even to myself. They made the guy resign, what more do you want from them? They can't go back in time with their newfound knowledge and fire him before it happened. The taxpayers of the town shouldn't have to pay so she can get rich for being a bitch.

Sue the officer, maybe, but not the town. I hate how people look at anything bad that happens to them as a get rich quick opportunity. I don't have audio, but I didn't see anything on that tape worth suing over.

If anyone else did what the cop did they would be in jail and rightful so. The cop should be charged with assult.

If you replaced a few of the words in the article this could just be another Darwin thread. However, one you throw the word 'cop' in there the stupidity of the other person is outweighed by the word 'cop'.

I don't agree with what happened to her but hell sometimes you just have to be smart or face the consequences.

Agreed. What exactly is the point of throwing someone around in this case? I don't see how ANYONE could possibly defend that. Even the police department isn't taking up for him in this case -- race issue or not.

The woman threw a ticket out the window...not a joint. She didn't throw punches. She didn't pull a gun.

why should she blow? there is no law saying she has to. just because the cop asked does not say she has to. we still have some choice.

as for disrespecting him. yeah it was rude. but he handled it wrong. as others said he should have given her a ticket for littering and told her it is stupid to throw it out since he already has all the information.

what he did was assault. glad he is not a officer anymore. hopefully nobody else hires the guy again.

What are you 12? This is an open and shut case. AND she passed her breathalyzer. People throw their tickets away all the time. What difference does it make? It's not like it disappears. He still issued it and will file it witht he court.

I saw a video once of a lady who did that, and the cop calmly wrote her up for litttering. That was great!

Sometimes this place makes me sad. There is a lot of free-floating anger and frustration with women among the members here, and it expresses itself in situations like this one.

My own feeling is that this woman is hardly a model citizen, and what she did was stupid, but the officer completely overreacted, and used significant force in a situation that required none. No decent police officer would do what he did, and if he is this lacking in composure he shouldn't be wearing a uniform. The department has, IMO, reacted appropriately (if anything I'm surprised and impressed they are so willing to admit he acted wrongfully), but they will still end up settling this case for a significant amount to get her to shut up, and to remove the case from the spotlight. I can live with that, even if it's a windfall to the "victim."

Oh really? Take away the police from your area and see how quickly crime goes up. Random patrols do prevent crime...the determined ones will commit crimes regardless.

What evidence is there that this was race-related other than the fact that she was black and he was white?

There might be people that are "so anti-race" because there are people that will slam that card down on the table any time two opposing colors are involved in an incident. It's an automatic reaction anymore.

I think there are still race-related problems, but I'm not going to jump to that conclusion in a specific incident without a drop of supporting evidence.

What the cop should do is to give her another ticket for loitering and more tickets if she keep on acting like a fool.

Everyone knows cops are under a lot of stress but you can't use force just because someone is acting like a fool.

Agreed. What he did was wrong; it's as simple as that. The officer lost his temper and ceased using good judgement when she threw the ticket out the window.

However, I have to admit that I find it someone gratifying when loud-mouthed twatbags - male or female - get their butts handed to them.

Note that I am NOT excusing his behavior.
