I'd go about your business as normal, you didn't do nothing so you aren't legally confined to your home.

And that sucks the punk didn't get killed.

I'm a witness to a police shooting, at least as far as they're concerned. I'm not going anywhere. I was told this in no uncertain terms.

They cannot detain you without arresting you for more than about 20 minutes. Or at least that is the general/broad rule I just learned in my Crim Pro class.

20 minutes is the generally acceptable duration of time permitted for a traffic stop. As far as this incident, I'm not familiar.

Call the sherriffs office or state police and tell them you have been kidnapped at your address. Things will work themselves out from there.

Yeah, but you might be failing that shit anyway. Besides, you should be railing your GF and not posting here. Shoo!

Wow. What a bunch of idiots. A cop gets stabbed and all you can think about is your right to go watch a movie. Pretend for just a moment that you are a decent fucking human being and you want to help them. I know it's cool to hate the police but being a tough guy in a situation where someone got hurt is pretty stupid and pointless. Bunch of fucking morons.

It's a cop. Who cares what happens to them.

A: One got shot too

B: There was absolutely nothing I could do to help

C: I wasn't being a tough guy, I hung around even though most people are saying I wasn't legally required to

D: You are so blindingly stupid it's kind of incredible.

Seriously, does Officer Friendly's wang actually taste good, or do you just enjoy the thought of taking a shot in the mouth from a police officer?

Sit. Roll over. Good dog.

Is there anything else you'd like to do for your master?

As other people have mentioned in this thread, they were not legally authorized to detain you like that. If they wanted to question you, you could have left them your contact information or grabbed their card.

I'd stick around without putting up a fuss for 2 reasons.

1. It's not worth the potential hassle if I do leave like the OP mentioned.

2. Odds are, whatever it is I want to do is not nearly as important as helping out in this situation. I know that if it were someone that I deeply cared about that got shot, I would really appreciate everyone to help in any way they can to catch the bastards. Not to mention that if this happened in front of my house, I would want them caught and locked up because I don't want anyone like that even close to my neighborhood. For I all know, these people live down the street from me.

I hope you at least got piss drunk while you were forced to wait.

Would have saved you from ever having to go to court as a reliable witness, at least. (Wish I saw this thread yesterday, could have really helped out. )

Just ask them if they are legally ordering you to stay in your home or if you are free to go. It seems that they are merely asking you and yet you think that they are legally ordering you. You need to be firm & exact in your questioning.

The rest of us have lives you know. If I came back for lunch during the day to grab a few things when this happened, then that would suck. Back in the summer I worked on plenty of design of experiments, where we needed appointments to run our validation studies. How would I feel if suddenly I got locked in my own home? What about people who have kids? Geez.

Being a good citizen is one thing, but when it gets in the way of my life, we all should have the right to choose our lives first. Ex: Voting. I don't vote on the day of. The last time people did that in 2004, my friends were in line at the polling station for 2 hours and didnt even get a chance to cast a vote because they just HAD to get going. That's why we have absentee ballots.

Interesting world we live in. If we don't obey a police officer's non-legally-binding orders, we have to live in fear of being abused or hassled for exercising our rights.

I don't think that one day of this mess constitutes living "in fear of being abused or hassled for exercising our rights". It's not like this sort of thing happens even once a year to the average person. For many, this kind of stuff will never happen to them. I am a firm believer in exceptions. Rights are very important to uphold of course, but sometimes one needs to ask themselves whether or not exercising their rights is worth it given a particular situation. It's not a good idea to constantly and blindly exercise your rights for the sake of exercising them.

Besides, I wouldn't be complying out of fear. I would mostly be complying because I feel it is the right thing to do. If you want to talk about "the world we live in" then maybe you should consider how little people do these days to help out those in need even if they are complete strangers and no reward is expected. That's much more sickening and common than the very rare case where a person is confined to their home for several hours in order to be questioned as a witness to a serious crime that happened on their property.

its not fair, but they're keeping you in the house for a reason. most probably to preserve the crime scene and to retain you as a witness.

if the person shot was your family member, you'd probably want the whole area quarantined so u could build a stronger case against the prick who committed the crime.

Some pretty uptight people around these forums when it comes to cops and legalities.

I would do what you are doing, just wait for them to come talk to you, screw a lawyer.
