Don't think so? Go down to the courthouse or the DMV or any city administrative office with a camera crew and an attitude and see how long you last.

This is true. There's a local judge here that will not allow news cameras in his courtroom. He says it would turn the trial into a circus.

You are both right and wrong. If you invite some one onto your land, even only implied and not expressed, you owe some duty of care to the visitor. Was this town hall a public event? Likely so and therefore implied consent was given. You cannot use "unreasonable" force to evacuate a visitor once they are on your land by invitation or also physically assault them.

At a DMV you have trained security personnel who are clearly identified as security guards who can use physical force if all other options where exhausted.

he directed us to the store exit wich was on the other side of the mall where we parked and it was hot as heck out. so we started going to the mall store exit part. my wife was 9 months pregnant and was very slow. he pushed her a little in the back and said to hurry up.

I turned to him and asked him to not touch or push her again. well he gets upset and decides to show me he is boss and push's her again. i got in his face and told him Not to do it again or i would consider that an assault . at that time 2 older plain clothes mall police stepped in and told the guy to not touch her again i would have the right to respond.

sure i would have got one hit in..then he would have kicked my ass LOL

Right. Excellent answer. You can't use "unreasonable " force since the town hall event meant the news team had an implied right to be there, but they could have demanded that they leave and called the cops to enforce that demand if they didn't.

And . . . no judge I know of would have convicted the PR guy of battery based on that tape.

After the first few touches, I would have told the PR guy, loud enough for the camera to catch, that the next time he touches me, I will be breaking his pinky finger on that hand.

Was the reporter being pushy? Absolutely. Does that mean that the report gave up his right to not be touched by a stranger? No.

Depends on your jurisdiction. Here in the US, that is battery. The threat of physical harm is assault.

I just watched it again. VERY early on in the conversation (at 11 seconds of the youtube video and before the PR guy showed up) the reporter asked if he could talk to her after the meeting.

He was willing to wait before the PR guy started harassing and assaulting him.
