I had a similar problem when I first bought my current house, the neighbor claimed the fence straddled the property line and needed to be replaced (and I had to pay half.) Her handyman had agreed to do it at an exorbitant rate and I balked. She had a lawyer friend write me a nice letter that was completely without any foundation in law so I called the county to mark the property line ($45) and it turned out it was an inch or so inside my property line.

I replaced the fence myself - even using cedar it came out $200 cheaper than my half would have been and no more complaints.

Exactly, the fence cannot be on the property line exactly...traditionally it should be about 2-3 inches on either side of it.

The moment you started doing the work yourself...you fvcked yourself royally.

You are now a contractor and as such took on the responsibility to do the work correctly...will you win if it goes to court? Probably...BUT plan on moving in the near future because they and their family will make your existence there as unpleasant as they can...take it from someone who has had problems with a neighbor.

Fortunately for me my b!tch neighbor is a 55+ grossly overweight 3 pack a day smoker who does not handle stress very well....I don't think she'll last long [crosses fingers]

Congrats

You went from not having a problem with the fence, to building a new fence and I bet you never see a dime from your neighbors. This whole situation seems like a ploy to get you to pay for their new fence.

I wouldn't lift another finger or buy any supplies until you have their portion of the $'s in hand.

If they are supplying the posts and panels and your just doing the labor, I would offer to put up the panels as originally agreed to and if that doesn't suit them drop it like a hot potato.

Whenever you deal with someone, get that crap in writing. Stranger, family (sometimes), friends just in case. I know you thought they were cool and all but that is exactly why you gotta do it for anyone you do a major task for. It protects not only you, but them as well.

What in the hell is it with fences and neighbours? About 10 years back, my assh*le-side neighbours took my family to court even after 2 surveys said it was perfectly (by us) on the property line. There were even death threats.

However, just recently, my good-side neighbours built a brand new fence at no cost to us. No complaints, no quarrels, nothing.

QFT, especially neighbors, strangers, and $ you lend friends that you ever hope to get back. you can also just have them say the agreement in your voicemail and that should be proof of an oral contract i would guess.

I moved into my house 2 years ago and have a dog, therefore I built a fence for my yard myself. I didn't go ask people for money, I needed it, not them, so it is my burden.


I have a nice big back yard, no kids, no dogs and no pool. I'm thinking of getting 7-8' cedar fence installed. But of course I'm going to be a decent neighbor and let both of them know what I plan on doing. I'll of course make sure that it's 100% on my property. If I have to mow on the other side of it, it's better than dealing with property line issues.

Why???? It's called privacy. I HATE NOSeY NEIGHBORS!.............. AND DOGS! Keep them from shi**ing and pissing in my yard eh? I mean the dogs btw **LMAO**

Well it sits on the property line. Generally. both neighbors will work it out and split the costs since they both get the benefits. At least that is what civil people do.

from my perspective, I would rather lose the 10-15cms of yard space on that side, and plant it on my own property, then listen to Granny Harridan and her knuckle-dragging kids...

My neighbor directly behind built a fence last year before we bought our place and now has asked me to treat our side of it at our cost and labor.

We're still considering our move, but the g/f is adamant we do it no questions asked...

You don't understand. This is for PRIVACY. I want my privacy, but in order to get it I also have to give it to you. Now surely you realize that it's unfair to me to pay for privacy for the both of us.

Not necessarily. Has to be within all the city or neighborhood guidelines and all.
But yeah, if you do build a fence that conforms to all that, you can do it anytime on your own property.

I would have never paid for the contractor either. I don't know why they would even attempt to do this behind your back. If they would have come to me like that I would have probably laughed at them and told them to pay for it. It doesn't matter that they are 80 years old, in my opinion. Thats a horrible excuse by their son.

As far as doing the work yourself? No way... I wouldn't have touched it. If they were so concerned to have the fence replaced by a contractor there is noway that they will be happy with a do it yourself job. No matter how good a job you do.

I hope you can get this resolved. In my opinion you did far more than the average person would to make their neighbor happy about a fence. If the fence is only 5 years old it couldn't have been in that bad of shape. You could have probably had it repaired and not replaced.

BTW, how did they know some of the poles were 2 inches off? Did they get out there and measure them? That's well within any tolerances a fence company would have.

I had some extra 8ft cross beams left over, and I had a tape measure. Basically they are almost perfectly 8ft, except for one. That is because the previous fence install used too much concrete, so my neighbor suggested I move it over a couple of inches. That panel will be behind a shed on both sides, so we didn't think anything of it. But his wife threw a hissy. Hehehe it was quite funny actually now that I look back on it.

Well the neighbors and I are both pretty sure it is on my property. I have called the city to get a ruling on it. I hope to get it before saturday, so I can put the fence up this weekend and not have to deal with them anymore.

Yep but that doesn't bother me. See, when she agreed to let me control the project, I had already won. I had planned on putting up a new one anyway. If I have to pay for all of it and it is on my side, then I am ok with that. I am thinking of painting their side of the wood bright pink. As long as I get a good coat on it, it should last
