Looks like this town is in violation of Missouri Law: 4.010
302.341. Moving traffic violation, failure to prepay fine or appear in court, license suspended, procedure ? reinstatement
when ? excessive revenue from fines to be distributed to schools.
. . . If any city, town or village receives more than forty-five percent of its total annual revenue from fines for
traffic violations occurring on state highways, all revenues from such violations in excess of forty-five percent of the
total annual revenue of the city, town or village shall be sent to the director of the department of revenue and shall be
distributed annually to the schools of the county in the same manner that proceeds of all penalties, forfeitures and fines
collected for any breach of the penal laws of the state are distributed.
4.010.Definitions
4. Notwithstanding the provisions of section 304.120 or any other provision of law to the contrary, cities, towns and
villages may regulate the speed of vehicles on state roads and highways within such cities?, towns? or villages? corporate
limits by ordinance with the approval of the state highways and transportation commission.
Any reduction of speed in cities, towns or villages shall be designed to expedite the flow of traffic on such state roads and highways to the extend consistent with public safety.
The commission may declare any ordinance void if it finds that such ordinance is:
(1) Not primarily designed to expedite traffic flow; and
(2) Primarily designed to produce revenue for the city, town or village which enacted such ordinance.
If an ordinance is declared void, the city, town or village shall have any future proposed ordinance approved by the highways and transportation commission before such ordinance may take effect.
I will file for a Freedom of Information act request Monday for them to provide how much revenue they are generating from traffic stops and ask for the engineering study showing the justification at that point on the road for an officer to be hiding there in the interest of "public safety".
