Wow this is f'ed up. So is this arrest and his incarceration now on his permanent record? How does this affect his ability to get/find work now? If it were me, I'd lawyer up, and sue the hell out of that precinct.

Why would a cop ask to search my car?

Numerous reasons.

Among them are:

1. To see if he can find something to arrest you for. You might have a pen-knife that he can call a 'switchblade' or maybe you might have a GoPro that he can say is a dangerous weapon.

2. To justify having wrongfully stopped you in the first place. Happens all the time.

3. To intimidate you when you've caught the fucker doing something wrong.

4. To retaliate against you for not 'respeckin' mah authoritah!'

5. Because you're black.

I have this on a business size paper in my wallet.

With all due respect officer, I wish to invoke my 4th and 5th Amendment rights. I do not answer questions from law enforcement without my attorney present nor do I agree to a search of my person or property. I would like to leave now, am I free to go?
I will just hand the cop that sheet of paper. No need to argue or be combative, or make any sudden move.

Good luck. Driving is supposedly a "privilege" and not a right, so therefore you have no right to an attorney regardless of what the constitution says.

Have you ever used this? How did it work out?

Since I have that paper, I had been stopped a few times but none of the cops asked to search me or my vehicle. Just recently, I was stopped because I did not wait for several second at a stop and the cop pulled me over but he was nice, told me his name, badge number, who he was, the reason why I was being pulled over, asked for my ID and insurance + registration, ran my plate and then told me to have a nice day. Nice fella and very professional, if only more cops were like him.

It is just a formal form of "HELL NO" to the search request from a cop of my vehicle or my person but with niceness.

I will keep say no and no and no but no yelling or screaming or be combative, and of course no sudden movement of body. IIRC, I do have a right to decline a search on my body or my vehicle unless the cop has a search warrant.

While driving is a privilege, being secure in your person and property is a right.

If this happened to me, its going to take about 30 million to make me feel better.

Three days later, the State Attorney's Office in Orlando filed paperwork, saying that it was dropping the case.

Rushing, who retired after 25 years as an Orlando parks department employee, has hired a lawyer and is asking the city to pay him damages.

"I got arrested for no reason at all," he said.

He has not spelled out how much money he wants, but attorney William Ruffier says he expects to file suit next month.

The Orlando Police Department did not explain why the two drug field tests that Riggs-Hopkins conducted were wrong.

if the tests are inadmissible in court why do persecutors rely on them? a savvy lawyer should easily get them thrown out.


They can be used as "probable cause" for a search.

They are used to scare people into a plea bargain. If you plead guilty to a lessor charge the test never goes to a trial.

The system only works if most cases are plead out. If everyone demanded a jury trial the courts would grind to a halt under the load.

We've all seen too many videos of people trying to exercise their "rights". Rights are an illusion, when a big guy with a gun who can legally get away with anything wants something from you, you can't say no.

But I'm not black.

And oddly enough neither was the guy in the article linked.

I guess it's just assumed that if you live in Florida and you drive a crappy car that you're a meth head.

I've always said no. I do it very respectfully but I won't let them search my car without a warrant. I've heard of too many issues with police fucking with people thinking it's funny, or someone who was in the car dropped something. Only once did the cop tell me he was going to get the warrant during a traffic stop. I told him I would happily wait. Ten mins later he came up and told me it was my lucky day and he had another higher priority issue to deal with. I wished him a good day and drove off. As long as I've been respectful I've yet to have a major issue with the police, even when I'm disagreeing with them.

Not true, you can lie like a rug, though they might not like it; - nope, haven't drank a drop, Nope, I wasn't speeding, nope, never been arrested before, ETC. Heck, tomorrow, thousands of lies will be told by cops in a courtroom, so why can't you? There was a time, MANY years ago, cops could not lie to you, but times have changed.
HOWEVER, after being read your rights, or under oath it *IS* a crime to lie to a **FEDERAL** officer. cough / Hillary / cough.
