Question about a Vista Sale I made

ok.. just recently I sold the Vista Home Premium Upgrade Version on Ebay 32bit & 64bit version.

The item was bought at a store as the "academic version", in addition I sold the 64bit upgrade DVD w/ it also (I ordered that from MS directly). Unused, valid key etc.. etc..

Sold for like $100 or so. Now I didn't list it was the academic version, never really thought about it, since the academic version and standard version are identical.

This was the gist of my listing --- "Microsoft Vista Home Premium Upgrade 32bit and 64bit DVD's. This item was bought retail and opened by myself. After realizing the upgrade DVD only came w/ a 32bit version I ordered the 64bit version from the Microsoft site. Thus, why 2 DVD's are shown in the picture"

the picture included was the actual picture of the box, 32bit DVD, 64 bit DVD from Microsoft.


so.... after the guy was sorta of a jerk sending me messages basically wanted it shipped to him via light speed. Now he says it's not what he wanted. States he wanted the retail version. Also he didn't use his name for shipping.. it sounds like a bs company called abcxtera inc. (or something like that). also the email isn't an ISP. it's a yahoo account.

so.. first I think this guy got exactly what I stated. $105 total I think is a pretty decent price for both DVD's shipped w/ Key. Also If I did even let him send it back.. what's ensuring me that he didn't install and click that Verify button on w/ Microsoft Key Code?

opinions (sorry for the length peoplz)


Nothing for sale in this thread and it's an ebay sale to boot, take it to off topic

I dont think you're allowed to resell Academic licensed products.

that's pretty shady of you.

um. yes you are. You act like I'm trying to make a living off buying academic software and selling it. I bought it and realized that it wasn't the version I needed. I was unaware home edition didn't allow for domain login. So I ended up buying a different version.

worst part is.. what if I get it back and the CD Key is already activated. Leaving me with no recourse. Just 2 worthless Vista Media DVD's.

They make great coasters! ;-) Academic version is for students & teachers only. If you shipped me that instead of the retail version I would be hot too.

if you didn't list it as the academic version in your listing, I would think that you are at fault since it is not "retail" (i.e. something you would buy in a retail store).

Sorry to say, but no matter what your non-trying to profit intentions were, Academic software is technically NFR. Plus you didn't list it as such.

Just eat it as a lesson learned I guess. Full disclosure goes a long way to prevent these sorts of messes.

Pretty much what every one else has said. Regardless of if you didn't want that version or not, it is only licensed to you and you did not disclose the version. The buyer is entitled to a 100% refund.

Yeah, put everything up front in a sell, there are some that are very picky, but in this case Academic software is NFR at all. So he is legit in his request.
I would suggest you say for him to Ship back the disks. You can call MS to see if they are unactivated. If they are unactivated give him his cheese back. No harm no foul.

if activated you can still activate tho right? also you can hack in features like home domain with ease so you should have done that before buying 3 versions of vista.. you should be banned from ebay for stunts like this.. give them the refund or find out the hard way

If activated and you have the original DVDs back, assuming you gave the guy refund and he did indeed activate it, there is a cose on the discs that MS will ask you for, then they will deactivate and then you can reactivate. They may question why you sold an acedemic but most likely not.

Very misleading ebay auction if you didn't state it was the academic version, as it is not meant retail sale. If he is indeed a business, he cannot lawfully use the academic version on the businesses computers. So I can understand him being pissed and wanting a refund.

You may also want to read Microsoft's policy in concerns with transfering/reselling the Academic version to other people, as you violated Microsofts policies:

Authorized Educational Resellers licensed by Microsoft may distribute academic versions of Microsoft software only to qualified end users. If you are an end user who wishes to transfer your academic software to another individual, it is your responsibility (as outlined in the End User License Agreement?s ?Software Transfer? clause) to ensure that the recipient is a qualified end user and that the recipient agrees to accept the terms of the software license. Qualified end users include educational institutions (including wholly owned educational hospitals), associated boards, faculty, staff, students of higher education institutions, public libraries and public museums. Distribution to individuals or organizations other than those listed here is NOT authorized.
