I got a speeding ticket. Boo hoo.

So my question is, if you "fight it", and lose, when is the date at which the clock starts ticking for when it gets "cleared" (for purposes of traffic school)?

Here's what I mean:

Assume you can do traffic school once every 18 months.

[All dates hypothetical/unimportant]: Get a ticket on Jan 1, 2015. Get 30 days to figure out what you want to do. Decide to fight it. Get a court date for, say, April 1. Get that delayed until May 15. Decision comes May 30th. You lose. Ticket counts.

The question is: Do you then have 18 months from May 30th before your ticket is "cleared", or do you have 18 months from the original infraction date, Jan 1st?

Jan 1st seems to make more sense, but I just wanted to be sure.

Thanks!

Best to contact the a court clerk and/or the DMV

My suspicion is they will use the May 30th data (in the example) becaase of people trying to game the system for the extra time.

Called the superior court, and at least according to the person I spoke to, it's "infraction to infraction".

So you could fight a ticket, make it take forever, and presumably that infraction would be in "limbo", and then by the time it was resolved, you'd have less time until you could do traffic school again.

This obviously only matters if you think you could somehow change the outcome...but it's not hard to envision fighting a ticket sort of lazily, having it be in limbo, and then getting ANOTHER ticket, and then realizing it might be worth your effort to spend some money to fight the first one.

Anyway, I'd always wondered this, so perhaps someone else did too.

I got a speeding ticket a few years ago. I just paid it and went to traffic school. Wasn't cheap though, you have to pay the fine plus the fee for traffic school. All told it was over $300.

It should be based on your "conviction" date, which is the date that the judge deemed you culpable of your infraction. Therefore, your court date.

Are you just concerned with your driving record, or when insurance stops considering it? Insurance can take a lot longer than 3 years.

It stays on your driving record for 3 years. You can go to Driving school once in a 12 month period!

That is wrong.
Once the courts say you lost your case you have a certain amount of time to pay the ticket and go to traffic school!
If you elect to go to traffic school you can go once in a 12 month period.

I do not know who told you the ticket would be in limbo...but if you fight the ticket its not likE going to court and taking years to decide whose at fault. also the courts will not put up with any stalling nonsense.
Get a lawyer and see what happens...good luck!

Thought it was once every 18 months for traffic school. I got out of my last ticket with a trial by written declaration.
