Question About Jailbreaking My iPod Touch 2G

I am not very literate when it comes to my iTouch. I have a model number A1288 8GB which I am told is 2nd Generation. Because of this, the latest version of the OS is 4.2.1. This severely limits my ability to upgrade apps. If I put whited00r on my iTouch will I be able to install the latest version of my apps? The most important to me are NY Times, Epocrates, and Skype. How would I install them, using iTunes? Also is this legal?

It violates the license agreement like any other jailbreak, but it's not going to get you fined or arrested. They do have version based on 4.2.1 for the 2nd gen Touch and iPhone 3G, but is merely interface tweaks. Neither version will let you run newer versions of your apps.
