Question on upgrading to iPhone

Here is is in short format

- 4 weeks ago go laid off, lost the company cell phone
- Went to ATT and picked up a cheap samsung phone on my wife's account with a new number so I had one to use during job hunt
- Last week, got a new job
- New job doesn't provide a new phone, but will pay for my current one (I prefer this method)

Now I want to take back the phone I have had for 4 weeks and get a 8gb iPhone (won't use it for music) or Windows Mobile phone. Is ATT going to charge me ungodly amounts of money since my new 2 year contract isn't up?

I didn't pick up a good phone because 1) I was unemployed and 2) some/most jobs in my field provide them.

I have only had this phone for about 4 weeks, so it is basically brand new.

Anyone have a clue how this works with ATT?

What's the cancellation policy with AT&T? It's been around a month for you (you said 4 weeks), can you return the phone and then switch? I think I'd go in person to an AT&T store and would ask them what they can do for you.

$399 is in my opinion too much for an early upgrade, I would pay $199 but not $399.

Oh well, tomorrow is day 30 and Monday is the earliest I could get to an ATT store. It is actually their loss, I wanted to drop $200 on a new phone and add a monthly data plan. This saves me money and loses them money.

Call the store tomm, they might be able to make an exception if you speak to the manager while your within your 30 day return policy and your only asking for a 1-day extension.

I was able to upgrade to an iphone even though I was only 5 or 6 months into my contract and ineligible for an actual upgrade. Got an 8gb black refurb iphone for $199 and it looks and acts brand new, as far as I can tell. I was already paying for a data plan with my blackberry, so all it cost me was a 5 or 6 month extension to my contract, as it renewed to a full two years once I placed the order for the phone.

You should count your lucky stars then. Read the post by TheBigZ. A coworker last month was told the same thing.

The OP should give it a shot though if he is still looking. All they can say is no.
