The reason I'm asking is because I want to file a conjunction against someone in small claims court for not paying damages for my car. But I'm sure I'll have a good chance in court because he signed an agreement with me saying that he'd pay damages, and he also agreed that he was at fault in the accident. I gave him three weeks, and as you can imagine.... we're entering week 4 now.

Injunction. A conjunction is "and".

If hes not paying damages, I'm not sure an injunction would be appropriate. Perhaps a lien and an exectution of the lien.

Get your car fixed, or get several estimates, sue the guy in small claims court. Then it's up to you to collect, the courts are not going to collect for you.

I have been in your shoes. The note needs to be signed and documented by a notary! I had to take a guy to small claims court for the same reason. I won but never did get my money. I do have a lien against a piece of land he owns. Not sure about the city attorney thing. My moms a lawyer.

small claims court has on upper limit on how much you can collect, so get the estimates first and then
check the laws in your state.

Mine was like a $1700 judgement.
He had to pay for my damages, the court costs, and attorney fee.

To get something notarized both parties have to sign it in front of the notary.
