Simple. Any merchandise you receive in the mail that you did not specifically order can be considered a gift under California law.
I did not specifically order a Sapphire 9800 card. I ordered a Sapphire 9800 Pro card. Have printouts of webpages right here.
If I receive a Pro, all is well. If I receive a 9800, I just received something I didn't order. Therefore, it's a gift, and I have no idea why my credit card was charged by that company - I haven't received what I ordered from them!

Yes, but there has been some banter about flashing the non-pro BIOS to the Pro BIOS and getting the same speeds with o/c'ing.
